<br />I <br /> <br />I <br /> <br />I <br /> <br />conformity, or remove it, within 30 business days of the date of the City Manager's notice of <br />reSCISSiOn. <br /> <br />Section 3.04. Any failure by the City to enforce this Agreement with respect to one or more defaults <br />by Tanger will not waive the City's ability to enforce the Agreement after that time. <br /> <br />PART 4. MISCELLANEOUS <br /> <br />Section 4.01. Term. The term of this Agreement will begin on the Effective Date, and will end on <br />the date the City issues a final certificate of occupancy or completion to Tanger related to the Project. <br /> <br />Section 4.02. Notice. Nondiscrimination. Tanger agrees to ensure that no discrimination occurs in the <br />provision of services or in employment practices at the Facility on the basis ofrace, creed, color, <br />national origin, sex or disability. <br /> <br />Section 4.04. Force Majeure. In the event that the performance by a party of any of its obligations <br />under this Agreement is interrupted or delayed by events outside of its control such as acts of God, <br />war, riot, or civil commotion, then the party is excused from such performance for the period of time <br />reasonably necessary to remedy the effects of the events. <br /> <br />Section 4.05. Severability. In the event any section, subsection, paragraph, sentence, phrase or word <br />is held invalid for any reason, the balance ofthis Agreement will remain in effect and will be read as <br />ifthe parties intended at all times not to include the invalid section, subsection, paragraph, sentence, <br />phrase or word. This Agreement may be amended only by a written instrument executed by both <br />parties. <br /> <br />Section 4.06. Construction; Governing Law. This Agreement will be construed under the laws of <br />the State of Texas. The term "will" is mandatory in this Agreement.
