<br />6. The City staff has identified conditions that need to be fulfilled or complied with in connection with <br />this request, as described in Part I below, and the City Council wishes to associate these conditions with the <br />approval of the Petitioner's petition. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The Petitioner's petition for extension of the City's wastewater system mains to serve the <br />Property is approved, and a variance from City Code Section 86.003( c) is approved for the extension, subject <br />to the following conditions: <br /> <br />A. The extension and all associated equipment, facilities and appurtenances must be constructed <br />at the sole expense of the Petitioner (subject to the City's policies on oversizing). <br /> <br />B. The extension and all associated equipment, facilities and appurtenances must be constructed <br />in accordance with the City's Technical Construction Standards and Specifications, the provisions of <br />Chapter 86 of the City Code, and all other applicable City regulations and standards. <br /> <br />C. The Petitioner must demonstrate, through engineering information submitted to and approved <br />by the Director of the Water and Wastewater Department, that adequate wastewater line capacity is <br />available in connection with any development or subdivision plat proposed for the Property. Significant <br />City utility improvement projects may need to be completed before this capacity will be available. <br /> <br />D. The Petitioner must fully comply with all applicable land development regulations, including <br />without limitation, the City's Land Development Code. <br /> <br />PART 2. The Petitioner's petition for annexation of the Property is approved, and the City staff is <br />directed to proceed to prepare a proposed service plan for the annexation of the Property. <br /> <br />PART 3. This Resolution shall be in full force and effect from and after its passage.
