I, HAYS COUNTY, TEXAS, BEING A <br /> <br />PORTION OF THE REMAINING PORTION OF LOT I, SAN MARCOS <br /> <br />DISTRIBUTION CENTER AS RECORDED IN VOLUME 2, PAGE 272 OF THE <br /> <br />HAYS COUNTY PLAT RECORDS AND BEING A PORTION OF THAT TRACT <br /> <br />DESCRIBED AS LOT 1 IN A DEED FROM BALKHOUSE ASSOCIATES TO THE <br /> <br />KROGER CO., DATED JULY 24, 2001 AND RECORDED IN VOLUME 1889, <br /> <br />PAGE 247, HAYS COUNTY OFFICIAL PUBLIC RECORDS, SAVE AND EXCEPT <br /> <br />THAT PORTION DEEDED TO THE STATE OF TEXAS RECORDED IN VOLUME <br /> <br />1501, PAGE 93, HAYS COUNTY OFFICIAL PUBLIC RECORDS AND BEING <br /> <br />MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS: <br /> <br />BEGINNING at a Texas Department of Transportation brass <br />monument found in the southeast line of Hunter Road (F.M. <br />2439) for the common south corner of that tract described as <br />0.608 acres in a deed from Balkhouse Associates to the State <br />of Texas dated October I, 1998 and recorded in Volume 1501, <br />Page 93, Hays County Official Public Records, the north corner <br />of that tract described as 0.910 acres in a deed from Concept <br />Designed Homes, Inc. to Nelson Investments dated February 25, <br />2003 and recorded in Volume 2165, Page 270, Hays County <br />Official Public Records and the east corner of that tract <br />described as 0.079 acres in a deed from Concept Designed <br />Homes, Inc. to the State of Texas dated December 3, 1997 and <br />recorded in Volume 1392, Page 208, Hays County Official Public <br />Records; <br /> <br />THENCE leaving the Nelson Investments tract and the State of <br />Texas 0.079 acre tract with the common southeast line of <br />Hunter Road (F.M. 2439), the north line of the remaining <br />portion of Lot I, San Marcos Distribution Center and the <br />southeast line of the State of Texas 0.608 acre tract, the <br />following three courses: <br /> <br />1. N44014'51"E 72.65 feet to a Yz" iron rod set; <br />2.
