Consider approval of Resolution 2011-160R approving a Memorandum of <br />Understanding between the City of San Marcos and Casey Development, Ltd., that <br />establishes processes for the possible consideration in the future of the abandonment of <br />portions of Public Rights -Of -Way within the project site for the Casey Development <br />Proiect, formerly referred to as the North Campus Housing Development off of Sessom <br />Drive, and for the dedication of easements and water utility infrastructure to the City; <br />authorizing the City Manager to execute said agreement; and declaring an effective date. <br />MOTION: Upon a motion made by Council Member Porterfield and a second by Council <br />Member Scott, the City Council voted (7) for and (0) opposed, to postpone Resolution 2011- <br />160R, as previously captioned indefinitely. The motion carried unanimously. <br />21. Consider approval of Resolution 2012-07R approving an Interlocal Agreement with the <br />Edwards Aquifer Authority pursuant to which the Authority will contribute funding to the <br />City in the amount of $250,000.00 toward the purchase of 107 acres of land for the <br />expansion of the Purgatory Creek Preserve greenspace, subject to the terms of a <br />conservation easement that will restrict the uses of the property to primarily passive <br />recreational uses; authorizing the City Manager to execute said agreement; and declaring <br />an effective date. <br />MOTION: Upon a motion made by Council Member Porterfield and a second by Council <br />Member Thomaides, the City Council voted (4) for and (2) opposed, Council Members Scott and <br />Thomason, (1) abstained, Council Member Prather abstained to avoid the appearance of <br />impropriety, to approve Resolution 2012-07R, as previously captioned. The motion carried. <br />22. Consider approval of Resolution 2012-08R approving an Agreement of Sale with the <br />Trust For Public Land for the City to purchase 107 acres of land for the expansion of the <br />Purgatory Creek Preserve ereenspace at a price of $1,600,000.00; authorizing the City <br />Manager to execute said agreement and related closing documents; and declaring an <br />effective date. <br />MOTION: Upon a motion made by Council Member Scott and a second by Council Member <br />Thomaides, the City Council voted (4) for and (2) opposed, Council Members Scott and <br />Thomason, (1) abstained, Council Member Prather abstained to avoid the appearance of <br />impropriety, to approve Resolution 2012-08R, as previously captioned.
