The Mayor introduced for consideration an Ordinance on first reading having the following caption: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES RESTRICTS THE LOCATION AnD USE OF BUILDINGS, STRUCTURES AND LAND, DA'I'ED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF 10.71 ACRES OUT OF THE J.M. VERN1ENDI LEAGUE NO. TWO; LOCATED AT PARKDALE DRIVE AND BROADWAY, FROM "R-l" (SINGLE FAMILY RESIDENTIAL) TO "D" (MULTI-FAMILY). AND I Mr. Hansen opened a Public Hearing to discuss the requested zoning change and reported that the applicant, C. R. Development (Kelly Kilber, agent) had requested that the item be withdrawn. No persons were present to present objections although the record contains petitions of objection. The Planning & Zoning Commission recommended denial. Following the Public Hearing, Mr. Breihan moved to direct Staff to withdraw the application. Mr. Tenorio seconded the motion which passed unanimously. The Mayor introduced for consideration an Ordinance on first reading having the following caption: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE l~ICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED ~ffiY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF 4.42 ACRES OUT OF THE MOCKINGBIRD HILL, SECTION TWO, ALSO KNOWN AS LOTS 1-10 OF BLOCK A AND LOTS 1-4 OF BLOCK C FROM "R-l" (SINGLE FAMILY RESIDENTIAL) TO "R-2" (DUPLEX). Mr. Hansen opened a Public Hearing to consider the requested zoning change. The applicant, Larry Roden, was not present. No objections were presented. Joe Garza, City Planner, reported that the Planning & Zoning Commission recommended approval and that the zoning change was in conformance with the Master Plan. VERAMENDI LEAGUE NO. TWO; LOCATED AT 703 UHLAND ROAD FROM "R-l" (SINGLE FAMILY RESIDENTIAL) TO "c" (COHIo1ERCIAL). The Mayor opened a Public Hearing to consider the requested zoning change. The applicant, Isabel DeLeon, informed the Council that he needed the zoning change to continue operating a machine shop on the premises. Mr. Tenorio asked staff to determine whether the use was classified as comm- ercial or industrial and if utility service was adequate. The City I Manager reported that utilities were available. Mr. Gonzalez also told the Council, that, while the Planning and Zoning Commission had recommended approval of the zoning change, the staff could not recommend the change feeling that it represented an encroachment into a residential neighborhood. Mr. James moved to approve the Ordinance on first reading. !1r. Cavazos seconded the motion which passed unanimously.
