The Contractor shall comply with Federal Management Circular (FMC) 73-2, 73-6, 73-8, 74-4, and 74-7 (OMB Circular A-21) and all revisions thereof, to the extent applicable to the Contractor and which concern the utilization of funds, procurement of goods and services, the operation of programs, and the maintenance of records, books, accounts, and other documents under the Act. Section 32. Independent Cont!act~ It is expressly understood and dgreed by both parties hereto that Department is contracting with the Contractor as an Independent Contractor and that the Contractor, as such. agrees to hold Department harmless and to indemnify it from and against any und all claims, demands and causes of ilction of every kind and character which may be asserted by any third party occurring or in any way incident to. arising out of, or in connection with, the servi ces to be performed by the Contractor under thi s contract.
