ORDINANCE 2012 -11 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AMENDING THE TRAFFIC REGISTER <br />MAINTAINED UNDER SECTION 82.067 OF THE SAN MARCOS <br />CITY CODE BY AMENDING THE SPEED LIMIT IN BOTH <br />DIRECTIONS OF THE FOLLOWING STREETS IN THE <br />COTTONWOOD SUBDIVISION FROM 30 MILES PER HOUR TO 25 <br />MILES PER HOUR: MONTERREY OAK, GOLDENROD DRIVE, <br />WILD PLUM, BRAZORIA TRAIL, AND WISTERIA WAY; AND <br />INCLUDING PROCEDURAL PROVISIONS. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />SECTION 1. Pursuant to Sections 82.003 and 82.066 of the San Marcos Code, on the basis of <br />finding that the prima facie speed limit is unreasonable and unsafe, the traffic register maintained under <br />Section 82.067 of the City Code is amended by adding the following speed limit: <br />Monterrery Oak from S.H. 123 to dead end (approximately 600 ft. from Goldenrod Drive), both <br />directions, 25 m.p.h.; <br />Goldenrod Drive from Monterrey Oak to Wisteria Way, both directions, 25 m.p.h.; <br />Brazoria Trail from Goldenrod to dead end approximately 150 ft. from Wild Plum, both directions, <br />25 m.p.h.; <br />Wisteria Way from Brazoria Trail to Monterrey Oak, both directions, both directions, 25 m.p.h.; <br />Wild Plum from Brazoria to the intersection of Monterrey Oak, both directions, 25 m.p.h <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be <br />unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will <br />continue in force if they can be given effect without the invalid portion. <br />SECTION 3. All ordinances and resolutions or parts of ordinances or resolutions in conflict with <br />this ordinance are repealed. <br />SECTION 5. This ordinance shall be in effect ten days from and after its passage. <br />
