18 regular meeting June 9, 1980 page two The Mayor introduced for consideration a request by Tom & Kim Murray for a temporary mobile home permit on Lot 77 of the A.M. Ramsey Addition, located at 107 Seguin St. Mr. Cavazos asked if the property owners were going to live there or if it was going to be rental property. On the application, it is listed as rental property. Mr. Cavazos moved to approve the request. Mr. Tenorio seconded the motion. On roll call, the following vote was recorded: AYE: Brow~, Cavazos, James, Kraus, Stokes, Tenorio I Norrls NAY: The Mayor introduced for consideration a request by Grant Harris for a temporary mobile home permit on Lot 47 of the A. M. Ramsey Addition, located at 201 Second St. Mr. Tenorio moved to approve the request. Mr. Cavazos seconded the motion. On roll call, the following vote was recorded: AYE: Brown, Cavazos, James, Kraus, Stokes, Tenorio NAY: Norris The Mayor introduced for consideration on first reading an Ordinance having the following caption: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE WHICH REGULATES AND RESTRICTS THE LOCATION AND USE OF BUILDINGS, STRUCTURES AND LAND, DATED MAY 23, 1966 (VOL. 32) BY CHANGING THE ZONING OF PART OF LOT 8 OF THE WEATHERFORD ADDITION FROM "I" (INDUSTRIAL) TO " C " (COMMERC IAL) . The Mayor opened a public hearing on this request. Cheryl Price, the agent representing Mrs. Leonilla Padilla, explained to Council the proposed use of the property. There was no opposition to the request. The Mayor then closed the public hearing. Mr. Cavazos asked why the zoning change to "C" was requested. The City Manager said that in order to obtain a conditional use permit for sale of alcoholic Beverages for on-premises consumption, the property must be zoned "C". Mr. James moved to approved the Ordinance on first reading. Mr. Cavazos seconded the motion, which passed unanimously. I The Mayor introduced for consideration a Resolution having the following caption: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, APPROVING AN AGREEMENT PERTAINING TO THE CONSTRUCTION OF A SANITARY SEWER SYSTEM TO SERVE SAN r,ffiRCOS BAPTIST ACADEMY; AUTHORIZING THE MAYOR OF SAID CITY TO EXECUTE SAID AGREEMENT AND ESTABLISHING AN EFFECTIVE DATE. Mr. Brown had a question about reimbursing the utility fund overruns with monies from the tax funds. The City Manager stated that the new rate structure should avoid this happening in the future. Mr. Brown moved to amend the agreement to provide for the Academy to assume full responsibility for relocation of the line so long as I the Academy was the sole user, and that if other customers were connected, the City would assume a pro--rata share of relocation expense based on usage. Mrs. Norris seconded the motion. The City Manager said that it was a common practice to place lines in the State right---of-way. The Mayor asked if revenues derived from the Academy over the next 20 years would compensate for moving the line. The City Manager said that could not be estimated. Mr. Stokes asked if the line would service other customers. The City Manager said it would on a limited basis and that additional lift stations would
