<br />18 <br /> <br />regular meeting <br /> <br />June 9, 1980 <br /> <br />page two <br /> <br />The Mayor introduced for consideration a request by Tom & Kim <br />Murray for a temporary mobile home permit on Lot 77 of the A.M. <br />Ramsey Addition, located at 107 Seguin St. Mr. Cavazos asked <br />if the property owners were going to live there or if it was going <br />to be rental property. On the application, it is listed as <br />rental property. Mr. Cavazos moved to approve the request. Mr. <br />Tenorio seconded the motion. On roll call, the following vote <br />was recorded: <br /> <br />AYE: <br /> <br />Brow~, Cavazos, James, Kraus, Stokes, Tenorio I <br /> <br />Norrls <br /> <br />NAY: <br /> <br />The Mayor introduced for consideration a request by Grant Harris <br />for a temporary mobile home permit on Lot 47 of the A. M. Ramsey <br />Addition, located at 201 Second St. Mr. Tenorio moved to approve <br />the request. Mr. Cavazos seconded the motion. On roll call, the <br />following vote was recorded: <br /> <br />AYE: Brown, Cavazos, James, Kraus, Stokes, Tenorio <br /> <br />NAY: Norris <br /> <br />The Mayor introduced for consideration on first reading an Ordinance <br />having the following caption: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING SECTION 3 OF THAT ORDINANCE <br />WHICH REGULATES AND RESTRICTS THE LOCATION AND USE <br />OF BUILDINGS, STRUCTURES AND LAND, DATED MAY 23, 1966 <br />(VOL. 32) BY CHANGING THE ZONING OF PART OF LOT 8 OF <br />THE WEATHERFORD ADDITION FROM "I" (INDUSTRIAL) TO <br />" C " (COMMERC IAL) . <br /> <br />The Mayor opened a public hearing on this request. Cheryl Price, <br />the agent representing Mrs. Leonilla Padilla, explained to Council <br />the proposed use of the property. There was no opposition to the <br />request. The Mayor then closed the public hearing. Mr. Cavazos <br />asked why the zoning change to "C" was requested. The City Manager <br />said that in order to obtain a conditional use permit for sale of <br />alcoholic Beverages for on-premises consumption, the property <br />must be zoned "C". Mr. James moved to approved the Ordinance on <br />first reading. Mr. Cavazos seconded the motion, which passed unanimously. <br /> <br />I <br /> <br />The Mayor introduced for consideration a Resolution having the <br />following caption: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN AGREEMENT PERTAINING TO <br />THE CONSTRUCTION OF A SANITARY SEWER SYSTEM TO SERVE <br />SAN r,ffiRCOS BAPTIST ACADEMY; AUTHORIZING THE MAYOR <br />OF SAID CITY TO EXECUTE SAID AGREEMENT AND ESTABLISHING <br />AN EFFECTIVE DATE. <br /> <br />Mr. Brown had a question about reimbursing the utility fund overruns <br />with monies from the tax funds. The City Manager stated that the <br />new rate structure should avoid this happening in the future. Mr. <br />Brown moved to amend the agreement to provide for the Academy to <br />assume full responsibility for relocation of the line so long as I <br />the Academy was the sole user, and that if other customers were <br />connected, the City would assume a pro--rata share of relocation <br />expense based on usage. Mrs. Norris seconded the motion. The City <br />Manager said that it was a common practice to place lines in the <br />State right---of-way. The Mayor asked if revenues derived from the <br />Academy over the next 20 years would compensate for moving the line. <br />The City Manager said that could not be estimated. Mr. Stokes asked <br />if the line would service other customers. The City Manager said <br />it would on a limited basis and that additional lift stations would <br />
