<br />I <br /> <br />I <br /> <br />I <br /> <br />24 <br /> <br />STATE OE TEXAS <br /> <br />x <br />X <br /> <br />AGREEMENT PERTAINING TO THE <br />CONSTRUCTION OF A SANITARY <br />SEWER SYSTEM TO SERVE Sfu~ MARCOS <br />BAPTIST ACADEMY <br /> <br />COUNTY OF _iAYS <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />That the City of San Marcos, Texas, a municipal corporation <br />, <br /> <br />existing by and under the laws of the State of Texas, acting <br /> <br />through authority conferred on its mayor, Kenneth V. Kraus, by <br /> <br />Resolution 80- <br /> <br />, adopted June 9, 1980, hereinafter "City" and <br /> <br />San Marcos Baptist Academy, a Texas non-profit corporation of the <br /> <br />County of Hays, State of Texas acting by and through its president, <br /> <br />Jack E. Byrom, hereinafter "Academy" enter into this agreemcmt upon <br /> <br />the following terms and conditions: <br /> <br />1. <br /> <br />For and in consideration of payment by Academy of the total <br /> <br />cost of the extension, City agrees to tne construction of a <br /> <br />sanitary sewer system to convey wastewater from property owned by <br /> <br />Academy in Hays County and outside the ~orporate limits of City, <br /> <br />said property being further described in the attached Exhibit A, <br /> <br />to City. City further agrees that sewage collected by said system <br /> <br />shall be treated at the San Marcos sewage treatment plant. <br /> <br />II. <br /> <br />Academy shall be responsible for development of plan~ for <br /> <br />said sanitary sewer system. Said plans shall be in conformance <br /> <br />with all laws, ordinances, rules, orders and regulations relating <br /> <br />to the construction of sanitary sewage collection and trea~ment <br /> <br />systems located on the Recharge Zone of the Edwards Arluifer in <br /> <br />Hays County. Academy shall recommend a contractor and contract <br /> <br />documents including technical specifications to City for approval <br /> <br />by City. City shall approve by Resolution the contract for <br /> <br />construction of said sanitary sewer system. Academy shall be <br /> <br />responsible for completion of the construction projection according <br /> <br />to the terms of said contract. <br />
