I I I 49 RESOLUTION NO. 1980-45R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN ~ffiRCOS, TEXAS, APPROVING A LETTER AGREEMENT BETWEEN SAID CITY AND PRO-TECH ENGINEERING GROUP, INC. FOR THE PROVISION OF ENGINEERING SERVICES NECESSARY FOR OBTAINING A PERMIT FROM THE TEXAS DEPARTHENT OF HEALTH FOR A SANITARY LANDFILL SITE; AUTHORIZING THE MAYOR OF SAID CITY TO EXECUTE SAID AGREE- MENT ON BEHALF OF SAID CITY AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of San Marcos, Texas desires to apply to the Texas Department of Health for a permit to operate a sanitary landfill on property owned by John A. Yarrington approximately five (5) miles north of the City of San Marcos in Hays County, Texas; and, WHEREAS, it is necessary to obtain engineering serVlces to aid the City in applying for this permit; and, WHEREAS, the City Council of said City believes Pro-Tech Engineering Group, Inc. to be fully qualified and able to provide such engineering services; now therefore, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TE XAS : PART 1. That the Letter Agreement between Pro-Tech Engineering Group and the City of San Marcos, Texas for the provision of engineer- ing services necessary to obtain a permit from the Texas Department of Health to operate a sanitary landfill on land owned by John A. Yarrington north of the city, a copy of which is attached hereto and incorporated herein for all intents and purposes, be, and is hereby, approved. PART 2. That the Mayor of said city Kenneth V. Kraus, be, and is hereby authorized to execute said Letter Agreement on behalf of the City of San Marcos. PART 3. That this Resolution shall be in full force and effect immediately upon its passage.
