II I II 55 RESOLUTION NO. 1980-46R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AUTHORIZING ACCEPTANCE OF THE COMPLETION OF WORK ON THE VICTORY GARDENS PHASE I PROJECT IN SAN MARCOS, TEXAS, AUTHORIZING FINAL PAYMENT TO DU-MOR ENTER- PRISES FOR THIS PROJECT; AND ESTABLISHING AN EFFECTIVE DATE. WHEREAS, the City of San Marcos, Texas, has contracted with Du-Mor Enterprises for the paving of and the making of necessary drainage improvements to Centre Street, Roose- velt Street, Patton Street, Truman Street and Eden Street in the City of San Marcos, Hays County, Texas; and, WHEREAS, said paving and drainage work has been com- pleted and Ou-Mor Enterprises, on June 25, 1980, requested final inspection on said construction; and, WHEREAS, the contracted amount of said paving and drainage improvements was four hundred twenty six thousand four hundred twenty eight dollars and eighty five cents ($426 ,428.85); and, WHEREAS, change orders on said project resulted in a total contract amount of three hundred seventy five thousand, thirty seven dollars and thirty four cents (~375,037.34); and, WHEREAS, previous payments to Du-Mor Enterprises have amounted to three hundred thirty seven thousand, five hundred thirty three dollars and sixty one cents ($337.533.61) WHEREAS, said final inspection was conducted on June 25, 1980; and WHEREAS, the Acting Director of Public Works of the City of San Marcos recommends that the City Council accept the Victory Gardens Phase I Project for: luse by the City as of June 25, 1980, and authorize final payment to Du-Mor Enterprises in the amount of thirty seven thousand, five hundred three dollars and seventy three cents ($37,503.73) ; now therefore BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TE XAS : PART 1. That the work performed by Du-Mor Enterprises in paving and making drainage improvements to Centre, Roose- velt, Patton, Truman and Eden Streets in San Marcos, Texas, be, and is hereby, accepted as being complete pursuant to the terms of the contract. PART 2. That the City of San Marcos is hereby authorized to make the final payment to Du-Mor Enterprises for said paving and drainage improvements in the amount of thirty seven thousand, five hundred three dollars and seventy three cents ($37,503.73) PART 3.
