<br />I <br /> <br />I <br /> <br />I <br /> <br />RESOLUTION NO. 1980-49R <br /> <br />76 <br /> <br />A RESOLUTION OF THE CITY COUNCIL <br />OF THE CITY OF SAN MARCOS, TEXAS, <br />SELECTING THE LOWEST AND BEST <br />BIDDER FOR THE VICTORY GARDENS, <br />PHASE II CONSTRUCTION PROJECT; AND <br />APPROVING A CONTRACT WITH DU-MOR <br />ENTERPRISES, INC. FOR CONSTRUCTION <br />OF SAID PROJECT; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, the City of San Marcos received bids on Tuesday, July 22, 1980 <br />for construction of utility, street, drainage and sidewalk improvements <br />in a project known as Victory Gardens Phase II Community Development <br />Program; and <br /> <br />WHEREAS, the low bid on said project was submitted by Du-Mor Enterprises, <br />Inc.; and <br /> <br />WHEREAS, City consulting engineers have reviewed all bids received and <br />recommend acceptance of the low bid; now, therefore, <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. That Du-Mor Enterprises, Inc. be recognized as the lowest <br />and best bidder. <br /> <br />PART 2. That the contract between City and Du-Mor Enterprises, Inc. <br />in the amount of $396,557.65 for the construction of Victory Gardens -, <br />Phase II be, and is hereby, in all things approved subject to the <br />contractor's furnishing of payment and performance bonds as specified <br />in paragraph 15 of the instructions to bidders. <br /> <br />PART 3. That the Mayor of said City, Mr. Kenneth V. Kraus, or his <br />successor, be, and is hereby authorized to execute said contract, subject <br />to the condition outlined in Part 2 above, on behalf of the City of <br />San Marcos, Texas. <br /> <br />ADOPTED this 28th day of July, 1980. <br /> <br />~...;1k y. ~ <br /> <br />~Kenneth V.
