I I II 148 MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, SEPTEMBER 11, 1980 PRESENT: Mayor Kenneth V. Kraus Council Members Karl W. Brown *Robert L. Gonzalez Doriss Hambrick Barbara Edwards ABSENT: Council Member Tess Norris Also Present: Gene Funk, Craig Farmer, Ken Moss, Sharyl Werner, Jake Krauskopf, Carlos Rodriguez, Ada Burke, William Liddle, Dr. Frank Rich, Ollie Giles, Frances Emery, John Kreczmer, Joe Garza, Jerri Martin, Betty Wolverton, Shirley Wickersham, Aart Millecam, Stephanie Langenkamp, Anita Miller and others. The Mayor called the meeting to order at 6:00 p.m. The Mayor introduced for consideration discussion of the Interim Subdivision Ordinance. There were no comments made on Article I. On Article II, Mr. Stokes had a question about the section on modular homes. Craig Farmer, representative from Freese & Nichols, Inc., said that this section could be deleted as there are no restrictions on the location of modular homes. Mr. Tarbutton questioned the 5 acre size on mobile home subdivisions. Mr. Stokes and the f1ayor were concerned about the size requirement. Mr. Stokes stated that 20 lots per site was a sufficient size. There were no comments on Article III. On Article IV, Craig Farmer stated that Section A needed to be rewritten to say that the more restrictive requirement prevailed. On Article V, Section C, the Mayor stated that a developer may only have intentions of developing a portion of his land and not know at the present time what the future use of the remaining portion of land will be. On page 79, Mr. Stokes wanted to require deed restrictions and that they be approved by Planning & Zoning. On Article VI, Mr. Brown stated that he would like to have a clause included to give Planning & Zoning and the Council the right to require more stringent provisions than just minimum standards. Mr. Stokes said that specific requirements needed to be specified in the Ordinance. The City Manager suggested designating environmentally sensitive areas such as the aquifer recharge zone. Mr. Stokes also recommended requiring new subdivisions have minimum lot sizes which were no smaller than 75% of the lot size of contiguous subdivisions. Mr. James was concerned about the parkland requirements. Mr. Farmer stated that a dollar figure needed to be set. Mr. Stokes felt that if the City takes the money from the developers and they forfeit it, the City should be responsible for constructing the parks. On Article VII, Mr. Brown stated that he wanted the subdivision utility requirements to parallel the new extension policy. Mr. Stokes said that he would like to see a time limit set up for the City to construct sidewalks. The Mayor stated that since the review of the Interim Subdivision Ordinance had taken so long, that a special meeting would be held on Monday, September 15, 1980 at 6:30 p.m. to discuss the Interim Zoning Ordinance. The meeting adjourned at 8:40 p.m. on motion of Mr. James and second of Mr. Tarbutton. ~ * Mr. Cavazos arrived at 7:15 p.m.
