<br />60 <br /> <br />1 <br /> <br />ORDINANCE 1980-46 <br /> <br />I <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS AMENDING ARTICLE III, ENTITLED <br />"FLOOD DAMAGE PREVENTION" OF CHAPTER 5, ENTITLED <br />"BUIIDINGS AND BUILDING REGULATIONS" OF THE CODE <br />OF ORDINANCES, CITY OF SAN MARCOS, TO ESTABLISH <br />METHODS OF REDUCING FLOOD LOSSES; DEFINE TERMS; <br />ESTABLISH ARFAS OF SPECIAL FLOOD HAZARD; SET PEN- <br />ALTIES FOR NONCOMPLIANCE; REQUIRE A DEVELOPMENT <br />PERMIT FOR CONSTRUCTION IN AREAS OF SPECIAL FLOOD <br />HAZARD; DESIGNATE THE CITY PLANNER AS THE ADMIN- <br />ISTRATOR OF THE ORDINANCE; AND ESTABLISH THE <br />PLANNER'S DUTIES PURSUANT TO THE ORDINANCE; SET <br />PROCEDURES FOR APPLICATION FOR VARIANCES AND D~S- <br />SIGNATE BODY TO CONSIDER SUCH -APplICATIONS; SET CONSTRUC- <br />TION STANDARDS FOR AREAS OF SPECIAL FLOOD HAZARD; <br />PROVIDE FOR SEVERABILITY AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />:SE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. That Article III of Chapter 5 of the Code of <br />Ordinances, City of San Marcos, Texas; is hereby amended to read <br />as follows: <br /> <br />ARTICLE III. FLOOD DAMAGE PREVENTION <br /> <br />Section 5-43. Statutory Authorization <br /> <br />I <br /> <br />The Legislature of the State of Texas has in Article <br />1011a, V.T.C.S. delegated the responsibility to local <br />governmental units to adopt regulations designed to <br />promote the public health, safety, and general welfare <br />of its citizenry. <br /> <br />Section 5-44. Statement of Purpose. <br /> <br />It is the purpose of this ordinance to promote the <br />public health, safety, and general welfare, and to <br />minimize public and private losses due to flood condi- <br />tions in specific areas by provisions designed: <br /> <br />(1) To protect human life and health; <br /> <br />(2) To minimize expenditure of public money <br />for costly flood control projects; <br /> <br />(3) To minimize the need for rescue and re- <br />lief efforts associated with flooding and <br />generally undertaken at the expense of the <br />general public; <br /> <br />(4) To minimize prolonged business interruptions; <br /> <br />I <br /> <br />(5) To minimize damage to public facilities and <br />utilities such as water and gas mains, electric, <br />telephone and sewer lines, streets and bridges <br />located in areas of special flood hazard; <br /> <br />(6) To help maintain a stable tax base by providing <br />for the second use and development of areas of <br />special flood hazard so as to minimize future <br />blight areas; <br /> <br />(7) To insure that potential buyers are notified that <br />property is in an area of special flood hazard; <br />and, <br /> <br />v <br />
