<br />Page 7 <br /> <br />shall obtain, review, and reasonably utilize any <br />base flood elevation data available from a Federa~ <br />State or other source, in order to administer <br />Sections 5-59(1), Specific Standards, Residential <br />Construction, and 5-59 (2), Specific Standar.&, Non- <br />residential Construction. <br /> <br />(3) Information to Be Obtained and Maintained <br /> <br />I <br /> <br />(a) Obtain and record the actual elevation <br />(in relation to mean sea level) of the <br />lowest habitable floor (including base- <br />ment) of all new or substantially im- <br />proved structures, and whether or not <br />the structure contains~ a basement. <br /> <br />(b) For all new substantially improved flood- <br />proofed structures: <br /> <br />(i) verify and record the actual elevation <br />(in relation to mean sea' level); and <br /> <br />(ii) maintain the floodproofing certifications <br />required in Section 5-54(3). <br /> <br />(c) Maintain iior public inspection all records <br />pertaining to the provisions of this ordinance. <br /> <br />(4) Alteration of Watercourses <br /> <br />(a) Notify adjacent communities and the (Texas DepartrrEnt <br />of w~ter Resources) prior to any alteration <br />or relocation of a watercourse, and submit <br />evidence of such notification to the Federal <br />Insurance Administration. <br /> <br />I <br /> <br />(b) Require that maintenance is provided within <br />the altered or relocated portion of said <br />watercourse so that the flood carrying capacity <br />is not diminished. <br /> <br />(5) Interpretation of FIRM Boundaries <br /> <br />Make interpretations where needed, as to the ex- <br />act location of the boundaries of the areas of <br />special flood hazards (for example, where there <br />appears to be a conflict between a mapped boundary <br />and actual field conditions). The person contesting <br />the location of the boundary shall be given a <br />reasonable opportunity to appeal the interpretation <br />as provided in Section 5-57. <br /> <br />Section 5-57. Variance Procedure. <br /> <br />(I) Appeal Board <br /> <br />I <br /> <br />(a) The Building Code Board of Adjustments and <br />Appeals as established by The City of San <br />Marcos shall hear and decide appeals and <br />requests for variances from the requirements <br />of this ordinance. <br /> <br />(b) The Building Code Board of Adjustments and <br />Appeals shall hear and decide appeals when <br />it is alleged there is an error in any require- <br />ment, decision, or determination made by the <br />City Planner in the enforcement or administra- <br />tion of this ordinance. <br /> <br />(c) In passing upon such applications, the Building <br />Code Board of Adjustments and Appeals shall <br />consider all technical evaluations, all relevant <br />factors, standards specified in other sections of <br />this ordinance, and: <br />
