In case of default by the Contractor, the Owner <br />may procure the materials, articles, or services from other <br />sources and hold the Contractor responsible for any excess <br />in cost occasioned thereby. <br /> <br />11. The Contractor shall: <br /> <br />-. Furnish evidence of comprehensive PUbl~ <br />liability ln ce coverage protecting th~/~er for <br />not less than $100, 0 per personand--r300, 000.00 <br />for any single occurrence . ___._ .udily injury or death <br />and $100,000.00 in the event of erty damage arising <br />out of the work perfd by the contracto; nd <br />evidence of insurance or other coverage requ' <br />l-Ocal law governing Workmen's Compensation; <br /> <br /> <br />(b) Obtain and pay for all permits and licenses <br />necessary for the completion and execution of the work <br />and labor to be performed; this includes compliance <br />with the requirements of the City of San Marcos for <br />contractor's bonds in the amount of $1,000.00 and for <br />contractor's licenses pursuant to the San Marcos City <br />Code; <br /> <br />(c) Abide by Federal and local regulations <br />pertaining to equal employment. <br /> <br />(d) Comply with the rehabilitation standards <br />and with all regulations, ordinances, and laws of the <br />City of San Marcos, the State of Texas, and the Federal <br />Government, as well as all regulations of any Governmental <br />Agency with jurisdictional interest and promptly secure <br />all necessary inspections and approvals required thereby <br />and permit access and inspections required by the said <br />Agencies or their Designees; <br /> <br />(e) Keep the premises clean and orderly during <br />the course of the work and remove all debris at the <br />completion fo the work; <br /> <br />(f) Not assign the Contract without written <br />consent of the Owner. The request for assignment <br />must be addressed to the Owner, c/o Community Develop- <br />ment Department of the City of San Marcos. <br /> <br />(g) Indemnify, save and hold harmless City and all <br />officers, agents, and employees of City from and against <br />all damages, claims, losses, demands, suits, judgements <br />and costs, including reasonable attorneys' fees and <br />expenses arising out of or resulting from the work which <br />is the subject of this contract and shall defend any <br />litigation arising in connection with such work whenever <br />said damages, claims, losses, demands, suits, and judge- <br />ments and costs including reasonalbe attorneys' fees and <br />expenses are caused in whole or in part by any negligent <br />act or omission of Contractor of any officer, agent or <br />employee of Contractor, regardless of whether said damages, <br />claims, losses, demands, suits, judgements including <br />reasonable attorneys' fees and expenses caused in part by <br />Owner. <br /> <br />12. The Owner shall: <br /> <br />(a) Permit the Contractor to use, at no cost, <br />existing utilities such as light, heat, power, and <br />water necessary to carrying out and completing the <br />work. <br />
