In case of default by the Contractor, the Owner may procure the materials, articles, or services from other sources and hold the Contractor responsible for any excess in cost occasioned thereby. 11. The Contractor shall: -. Furnish evidence of comprehensive PUbl~ liability ln ce coverage protecting th~/~er for not less than $100, 0 per personand--r300, 000.00 for any single occurrence . ___._ .udily injury or death and $100,000.00 in the event of erty damage arising out of the work perfd by the contracto; nd evidence of insurance or other coverage requ' l-Ocal law governing Workmen's Compensation; (b) Obtain and pay for all permits and licenses necessary for the completion and execution of the work and labor to be performed; this includes compliance with the requirements of the City of San Marcos for contractor's bonds in the amount of $1,000.00 and for contractor's licenses pursuant to the San Marcos City Code; (c) Abide by Federal and local regulations pertaining to equal employment. (d) Comply with the rehabilitation standards and with all regulations, ordinances, and laws of the City of San Marcos, the State of Texas, and the Federal Government, as well as all regulations of any Governmental Agency with jurisdictional interest and promptly secure all necessary inspections and approvals required thereby and permit access and inspections required by the said Agencies or their Designees; (e) Keep the premises clean and orderly during the course of the work and remove all debris at the completion fo the work; (f) Not assign the Contract without written consent of the Owner. The request for assignment must be addressed to the Owner, c/o Community Develop- ment Department of the City of San Marcos. (g) Indemnify, save and hold harmless City and all officers, agents, and employees of City from and against all damages, claims, losses, demands, suits, judgements and costs, including reasonable attorneys' fees and expenses arising out of or resulting from the work which is the subject of this contract and shall defend any litigation arising in connection with such work whenever said damages, claims, losses, demands, suits, and judge- ments and costs including reasonalbe attorneys' fees and expenses are caused in whole or in part by any negligent act or omission of Contractor of any officer, agent or employee of Contractor, regardless of whether said damages, claims, losses, demands, suits, judgements including reasonable attorneys' fees and expenses caused in part by Owner. 12. The Owner shall: (a) Permit the Contractor to use, at no cost, existing utilities such as light, heat, power, and water necessary to carrying out and completing the work.
