ORDINANCE 2012 - 12 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING PROVISIONS OF CHAPTER 86, UTILITIES, ARTICLE 4 — ELECTRICITY, PERTAINING TO THE PROCESS FOR PROMULGATING, REVISING, AMENDING AND SUPPLEMENTING THE RULES, REGULATIONS AND LINE EXTENSION POLICY; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The following sections of Chapter 86, Article 4 — Electricity, of the Code of Ordinances are amended as follows (underlining indicates added text; stlikethfough indicates deleted text): Sec. 86.176. - Rules and regulations and Line Extension Policy The city council is authorized and directed to promulgate, revise, amend and supplement the city electric utility rules and regulations and the line extension policy for electric service, subject to the following: (1) The city council may propose changes to the rules and regulations and line extension policy. A public hearing must be held to discuss the proposed rules and regulations or line extension policy. (2) Proposed rules and regulations or the proposed line extension policy shall be made available to the public by publishing them on the city's website and filing at the City Clerk's office on or before the date of publication of notice of a public hearing. Notice of a public hearing must be given not more than 22 days or less than eight days before the public hearing is held. (3) Adoption of proposed rules and regulations or proposed line extension policy by the city council may occur after a public hearing has been closed and not more than 30 days thereafter, or the council must schedule, provide public notice for and conduct a separate public hearing before the proposed rules and regulations may be adopted. (4) Any final rule or regulation or line extension policy that is adopted by the city council must be published on the city's website. (5) A rule or regulation adopted by the city council shall not take effect less than 30 days from the date of its adoption by the city council . (6) Any and all amendments of the electric utility rules and regulations or line extension policy adopted by the city council shall be published on the city's website, provided to the city clerk
