27 THE STATE OF TEXAS ~ COUNTY OF HAYS ~ LEASE OF WASTE DISPOSAL SITE This agreement of lease made and entered into this I 22nd day 0 f December JOHN YARRINGTON, hereinafter called 1980, by and between "Yarrington", and the CITY OF SAN MARCOS, TEXAS, a municipal corporation existing by and under the laws of the State of Texas, acting through authority conferred on its Mayor, Kenneth V. Kraus, by resolution duly enacted on the 22nd day of December 19 80 , hereinafter called "City". I. I In consideration of the mutual covenants and agreements herein set forth, and other good and valuable consideration, Yarrington does hereby demise and lease to City, and City does hereby lease from Yarrington, the premises situated in Hays County, Texas, described in the attached Exhibit A, which is hereby made a part of this agreement for all intents and purposes, said premises not constituting any part of the homestead of said John Yarrington, said premises hereinafter referred to as "The Site". I t is expressly agreed that this lease shall include the right of ingress and egress over and across other adjoining lands owned by Yarrington. II. I As consideration and rental for the demised premises City agrees to pay to Yarrington the sum of Two Hundred and NO/lOa Dollars ($200.00) per month for the initial twelve (12) month period and Three Hundred and NO/lOa Dollars ($300.00) per month for the second twelve (12) month period, until the City begins actual use of the leased premises for solid waste disposal, which actual use shall begin, in any event, within two years of the date of the execution of this lease by City. Each payment to be made in advance beginning on the date of the execution of this lease by City. On the date City begins actual use of
