<br />I <br /> <br />reasonable time upon the showing of good cause for <br />such an extension. City will be solely responsible for <br />obtaining all materials and all costs in connection with <br /> <br />any lining, backfilling, or covering necessary to meet and <br /> <br />conform with Texas Department of Health requirements. City <br /> <br /> <br />specifically agrees to cover the sanitary fill with topsoil <br /> <br /> <br />in conformity with the requirements of the State of Texas <br /> <br /> <br />licensing of such a site. Said topsoil and all cover <br /> <br /> <br />materials shall be furnished by City. <br /> <br /> <br />IV. <br /> <br /> <br />It is expressly agreed that City shall have the <br /> <br /> <br />right to terminate this lease at the end of each yearly <br /> <br /> <br />period by giving sixty (60) days written notice to Yarrington, <br /> <br /> <br />provided, however, if City chooses not to exercise said <br /> <br /> <br />right of termination the term of this lease shall be for the <br /> <br /> <br />life of the Site. Prior to the time City begins actual use <br /> <br /> <br />of the Site for waste disposal purposes, City may terminate <br /> <br /> <br />the lease by giving Yarrington thirty (30) days written <br /> <br /> <br />notice of intent to terminate. Notwithstanding the pre- <br /> <br /> <br />ceeding provisions, if Yarrington or City fails to carry out <br /> <br /> <br />any provision of this lease, the other party shall have the <br /> <br /> <br />right to terminate the lease by giving written notice of <br /> <br /> <br />such termination, provided, however, written notice has been <br /> <br /> <br />given the defaulting party of such default, and the offending <br /> <br /> <br />party has continued in default for thirty (30) days after re- <br /> <br /> <br />ceiving written notice of such default. If City fails to <br /> <br /> <br />begin actual use of the leased premises within the 2 year <br /> <br /> <br />period provided for in Paragraph II of this Agreement, then <br /> <br />Yarrington shall have the right to terminate this lease by <br /> <br />giving 30 days written notice as provided for under the <br /> <br /> <br />provisions of this Paragraph. Nothing contained herein <br /> <br />constitutes a waiver of the right of either party to damages <br /> <br /> <br />occasioned by breech. <br /> <br />I <br /> <br />I <br /> <br />V. <br /> <br /> <br />Upon termination; City shall have the right to <br /> <br /> <br />remove additions or improvements made by City during the <br /> <br /> <br />term of the lease provided that said additions or improve- <br /> <br /> <br />ments can be removed without damage to the demised premises. <br />
