I-l::' <br />(::5~ <br /> <br />55 <br /> <br />ORDINANCE 1999- 18 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING SECTION 2.211 (B) OF <br />THE CITY CODE TO CHANGE THE TERMS OF OFFICE <br />FOR MEMBERS OF THE MAIN STREET ADVISORY BOARD <br />FROM TWO YEARS TO THREE YEARS; INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENAL TIES. <br /> <br />RECITALS: <br /> <br />1. The Main Street Advisory Board has requested that two changes be made in the <br />ordinance which defines the term of office of the Board's members. <br /> <br />2. The 1997-98 Citizen Review Board has recommended that the City Council consider <br />this request. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. Section 2.211(b) of the City Code is amended, and Section 2.211(c) is <br />added, as follows (underlining indicates added text; o'v'erstrike indicates deleted text): <br /> <br />(b) Members are appointed to three-year fivo-year staggered terms with the <br />terms of one-third of the members expiring each April 30th eight of them expiring <br />April 30 of odd-numbered years and the terms of seven expiring April 30 of even- <br />numbered years. The members will, at their meeting in May of each year, elect a <br />chairperson, vice-chairperson and secretary. They may elect other officers and form <br />committees as they may determine necessary for the proper performance of their <br />duties. <br /> <br />c) Members of the Main Street advisory board who are ineligible for <br />reappointment under Section 2.068 of this code remain ineligible for a period of one <br />year from the expiration of their last term of office, rather than for a full term of office <br />as stated in Section 2.068(e) of this code. <br /> <br />SECTION 2. Current members of the Main Street Advisory Board will serve the two-year <br />terms of office to which they were appointed, and vacancies in these positions will be filled <br />for the remainder of the current terms. New appointments to regular terms on the Board <br />in 1999 and 2000 will decide their terms of office by drawing lots, according to the following <br />schedule: <br /> <br />1999- 8 appointments <br /> <br />2000-9 appointments <br /> <br />2-1 year (exp. 2000) <br />3-2 year (exp. 2001) <br />3-3 year (exp. 2002) <br /> <br />2-1 year (exp. 2001) <br />2-2 year (exp. 2002) <br />5-3 year (exp. 2003) <br /> <br />Those drawing terms of office of one or two years will not have their initial term count as <br />a term of office under City Code Sec. 2.068. <br /> <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions <br />of this ordinance will continue in force if they can be given effect without the invalid portion. <br /> <br />SECTION 4. All ordinances and resolution or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br /> <br />SECTION 5. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />
