Hopkins Street San Marcos, Texas 78666 San Marcos , Texas, March 23 1999 , - The investment in lines and equipment which will be necessary for the Cooperative to make in order to furnish you electric service at your w ate r t rea t men t p 1 a n t16cated 2 (two) miles, MS-E-N of San Marcos , Texas, Map Reference 69 - 0 1 - 97-11 applied for you in your (application) (request) (contract) for service dated 19 , is of such a nature that a contribution in aid of construction will be required, We can only furnish this service in accordance with the terms and limitations of this agreement which requires that you pay the Cooperative without recourse Forty Thousand Eigfit Hundred ninety six and nO/){)ollars($40,896.00/x~ to defray the cost of construction, and on the further condition that we shall at all times have complete ownership and control of the entire line, with the right to serve others from said line, and/or any extension thereof, without any obligation to refund any part of the above payment to you. This agreement and all contracts entered into by applicant and Cooperative shall be contingent upon (a) the Cooperative's ability to obtain easements with a normal and reasonable effort, excluding condemnation pro- ceedings, (b) acts of any governmental authority or court of law, (c) acts of God, (d) inability to secure mate- rials and/or labor, (e) any other cause beyond the Cooperative's reasonable control. The cost of obtaining easements after a normal and reasortable effort has been made by the Cooperative shall be borne by the applicant. This amount shall be paid as a contribution in aid of construction and added to the original amOll:1-'lt shown above. This agreement is supplemental to all other agreements entered into between the applicant and the Coop- erative. Please indicate your acceptance of this proposition by signing below and enclosing your check for the amount shown above. This proposal is good for 60 days.
