<br />of the Phase I Capacity for a portion of the Prime I Subdivision. This capacity equates to 263 <br />Service Unit Equivalents ("SUEs"). The Reserved Capacity will be reduced for each City <br />wastewater impact fee service unit issued by the City to SMII for use of the Wastewater <br />Improvements and the resulting Reserved Capacity will be deemed the "Adjusted Reserved <br />Capacity." The City will monitor wastewater flows at the lift station, and at such time that the City <br />reasonably determines it will be unable to meet its obligation to provide the Adjusted Reserved <br />Capacity to SMII, the City will undertake improvements to provide the Adjusted Reserved Capacity <br />to SMII or refuse requests for wastewater service other than from SMII. The City may provide <br />alternative means for wastewater collection for those requests refused under this paragraph. <br />8. After July 1,2000, it is anticipated that projected development, exclusive of the proposed <br />SMII development, may require an increase in the capacity of the Wastewater Improvements. <br />Additional improvements (the "Expanded Improvements") to the lift station and force main beyond <br />those described in Paragraph 2 ofthe Recitals would be required to meet a Phase II capacity of 1330 <br />g.p.m. (the "Phase II Capacity"), see Exhibit "A". The City agrees to reserve for SMII an additional <br />192 g.p.m. (peak flow) out ofthe Phase II Capacity. This Phase II Reserved Capacity equates to an <br />additional 313 service unit equivalents. The additional 313 SUEs reserved as part of the Phase II <br />Capacity will be reduced for each wastewater impact fee service unit issued by the City to SMII for <br />use of the Expanded Improvements. <br />9. The City and SMII agree that if SMII requires capacity in excess of the 263 SUEs reserved <br />in the Phase I Capacity, SMII will design and construct the Expanded Improvements in compliance <br />with the procedures for the Wastewater Improvements described in Paragraphs 2,3 and 5 of this <br />Agreement. The City agrees to pay 100% of the cost of construction of the Expanded Improvements <br />to SMII, the estimated cost for which is $150,000. This payment will be made in a lump sum no <br />later than 30 days after acceptance of the Expanded Improvements by the City. The parties <br />acknowledge that SMII's share of the cost of the Wastewater Improvements and the Expanded <br />Improvements will be at least one-third of the combined cost of these improvements.. <br />10. The Phase II Reserved Capacity will be reduced for each City wastewater impact fee <br />service unit issued by the City to SMII for use of the Wastewater Improvements and the resulting <br />Reserved Capacity will be deemed the "Phase II Adjusted Reserved Capacity."
