<br />89 <br /> <br />RESOLUTION 1999 - 72R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF <br />THE CITY OF SAN MARCOS, TEXAS <br />APPROVING A LICENSE AGREEMENT <br />BETWEEN THE C'ITY AND UNION PACIFIC <br />RAILROAD COMPANY FOR THE <br />INSTALLATION OF A WASTEWATER <br />P'IPEUNE CR'OSSillNG RAILR'OAD TRACKS il!N <br />CALDWELL C'OUNTY; AUTHORIZING THE <br />CITY MANAGER TO EXECUTE THE LICENSE <br />AGREEMENT; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The Union Pacific Ra!i!lroad Company ("Ra!iilroad") owns prop'erty ilocatedwithin <br />Caldwell County that is an integral part of the transmission wastewater pipeline route from <br />the Camp Gary to the City of San Marcos. <br /> <br />2.. The City desires to enter !into theaUach'ed License Agr1e'ement with the Railroad <br />for the installation, maintaining and operation an 8" wastewater pipeline crossing the <br />Railroad property. <br /> <br />N'OWTiHEREFORE, BElT RES'OLVED BY THE CiITY C'OUNCIL 'OF THE GITY 'OF <br />SAN MARC'OS, TEXAS: <br /> <br />PART 1. The attached License Agreement between the City and Union Pacific <br />Railroad Company is approved. <br /> <br />PART 2. The City Managrer, Larry iO.
