'S- \S'"" ~ 1"\ N 0::: ;,,;;;;,: ~ ORDINANCE 1999- 21 108 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIALZONING MAP OF THE CITY BY REZONING LOTS 58, 59 AND 60 OF THE SOUTHENDADDITION LOCATED AT 610, 614 and 618 GEORGIA STREET FROM "M" SINGLE-FAMIL Y, DUPLEX AND NEIGHBORHOOD BUSINESS DISTRICT TO "R-2" SINGLE-FAMILY DWELLING DISTRICT (MEDIUM DENSITY); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. RECITALS: 1. On February 23, 1999, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "M" Single- Family, Duplex and Neighborhood Business District to "R-2" Single-Family Dwelling District (Medium Density) for Lots 58,59 and 60 of the Southend Addition located at 610,614 and 618 Georgia Street. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on February 23, 1999 consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City. 3. The City Council held a public hearing on the 12th day of April , 1999, regarding the request. 4. All requirements of Chapter 114, Zoning, ofthe San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to rezone the following real property which is presently zoned "M" Single-Family, Duplex and Neighborhood Business District to "R-2" Single-Family Dwelling District (Medium Density): Street address: 610,614 and 618 Georgia Street. Legal description: Lots 58, 59 and 60 of the Southend Addition. Deed or plat reference: Volume 55, page 601, Hays County Deed Records. SECTION 2. Any person violating any provision of this ordinance commits a misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. SECTION 3. After its original passage, this ordinance will be subject to reconsideration at the next regular City Council meeting. If this ordinance is not reconsidered, or if it is reconsidered and approved, notice of its adoption will be published in a newspaper of general circulation in the City. This ordinance will take effect upon publication of this notice. PASSED, APPROVED AND ADOPTED this 12th day of April 1999, subject to reconsideration at the next regular City Council meeting scheduled for April 26, 1999.
