<br /> <br />'S- <br />\S'"" <br />~ <br />1"\ <br />N <br />0::: <br />;,,;;;;,: <br />~ <br /> <br /> <br />ORDINANCE 1999- 21 <br /> <br />108 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIALZONING <br />MAP OF THE CITY BY REZONING LOTS 58, 59 AND 60 OF <br />THE SOUTHENDADDITION LOCATED AT 610, 614 and 618 <br />GEORGIA STREET FROM "M" SINGLE-FAMIL Y, DUPLEX <br />AND NEIGHBORHOOD BUSINESS DISTRICT TO "R-2" <br />SINGLE-FAMILY DWELLING DISTRICT (MEDIUM DENSITY); <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING <br />FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. On February 23, 1999, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning from "M" Single- <br />Family, Duplex and Neighborhood Business District to "R-2" Single-Family Dwelling District <br />(Medium Density) for Lots 58,59 and 60 of the Southend Addition located at 610,614 and <br />618 Georgia Street. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on February 23, 1999 consider and vote to approve the request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 12th day of <br />April , 1999, regarding the request. <br /> <br />4. All requirements of Chapter 114, Zoning, ofthe San Marcos City Code pertaining <br />to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br />of the San Marcos City Code, is amended to rezone the following real property which is <br />presently zoned "M" Single-Family, Duplex and Neighborhood Business District to "R-2" <br />Single-Family Dwelling District (Medium Density): <br /> <br />Street address: <br /> <br />610,614 and 618 Georgia Street. <br /> <br />Legal description: Lots 58, 59 and 60 of the Southend Addition. <br /> <br />Deed or plat reference: Volume 55, page 601, Hays County Deed Records. <br /> <br />SECTION 2. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 3. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br />in a newspaper of general circulation in the City. This ordinance will take effect upon <br />publication of this notice. <br /> <br />PASSED, APPROVED AND ADOPTED this 12th day of April <br />1999, subject to reconsideration at the next regular City Council meeting scheduled for <br />April 26, 1999. <br />
