<br />Property: All of Lot Nos. 6, 7, 8, 9 and part of Lot No. 10, Block No. 16 of the Original Town of San
<br />Marcos, according to the map or plat thereof recorded in Volume 46, Page 448 of the Hays County Deed
<br />Records, and as described in a deed dated November 13,1967, from Joe Marks to the San Marcos Coca-Cola
<br />Bottling Company, recorded in Volume 221, pages 305-306 of the Hays County Deed Records; a part of Lot
<br />No. 10, Block No. 16 of the Original Town of San Marcos, according to the map or plat thereof recorded in
<br />Volume 46, Page 448 of the Hays County Deed Records, and as described in a deed dated November 26,
<br />1966, from Ruben Ruiz to the San Marcos Coca-Cola Bottling Company, recorded in Volume 214, pages
<br />574-575 of the Hays County Deed Records; and the most northern half of Lot No. 11, Block No. 16 of the
<br />Original Town of San Marcos, according to the map or plat thereof recorded in Volume 46, Page 448 of the
<br />Hays County Deed Records; and being the same property as described in a deed from Terry P. Gilmore to
<br />the City of San Marcos and the San Marcos Industrial Foundation, as recorded in Volume 1152, Pages 712-
<br />713 of the Hays County Official Public Records.

<br />Reservations from and Exceptions to Conveyance and Warranty: Easements, rights-of-way, and
<br />prescriptive rights, whether of record or not, all presently recorded restrictions, covenants, conditions, and
<br />other instruments, other than liens and conveyances, that affect the property; any discrepancies, conflicts,
<br />or shortages in area or boundary lines; and any encroachments or overlapping of improvements.

<br />Grantor, for the consideration and subject to the reservations from and exceptions to conveyance and
<br />warranty, grants, sells and conveys to Grantee all of Grantor's two-thirds interest in and to the Property,
<br />together with aU and singular the rights and appurtenances in any wise belonging, to have and hold it to
<br />Grantee, Grantee's heirs, executors, administrators, successors or assigns forever. Grantor binds Grantor and
<br />Grantor's successors and assigns to warrant and forever defend all and singular the Property to Grantee and
<br />Grantee's heirs executors, administrators, successors and assigns against every person whomsoever lawfully
<br />claiming or to claim the same or any part, when the claim is by, through or under Grantor, but not otherwise.
<br />
<br />Grantee, by accepting this conveyance, covenants and agrees that the property shall be used for the operation
<br />of a small business incubator (in substantially the same manner in which it is being operated at the present
<br />time), or a small business development center, for at least the period of time from the date of this conveyance
<br />to March 1,2001.
