<br />125 <br /> <br />RESOLUTION 1999-~R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS EXPRESSING THE CITY'S OPPOSITION TO H.B. 2916, <br />PENDING IN THE 76TH TEXAS LEGISLATURE, AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />WHEREAS, H.B. 2916, pending in the 76th Texas Legislature, would amend the <br />definition of "underground water" in the Edwards Aquifer Authority (EAA) Act to allow <br />persons with wells along the southern edge of the aquifer such as Living Waters Artesian <br />Springs, Ltd., to argue that the water they produce is not subject to regulation by the EAA at <br />all, leaving less aquifer water available for the rest of the aquifer's users, and for natural <br />springflow; and <br /> <br />WHEREAS, H.B. 2916 would amend the "permit floor" provisions of the EAA Act, <br />which establish the minimum amounts for all permits based upon aquifer use during a set <br />period of time, to remove the "floor" for all users other than agricultural irrigators, resulting <br />in an increase in water available for farmers, and a dramatic decrease (between 15-25%) in <br />water available for all other users, including San Marcos; and <br /> <br />WHEREAS, H.B. 2916 would upset the delicate balancing of interests presently <br />contained in the EAA Act; now, therefore <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS. <br />TEXAS: <br /> <br />PART 1. The City of San Marcos OPPOSES H.B. 2916. <br /> <br />PART 2.
