<br />130 <br /> <br />RESOLUTION 1999- 88R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS SUPPORTING THE TRANSFER OF EXTRATERRITORIAL <br />JURISDICTION FROM THE CITY OF AUSTIN TO HAYS COUNTY <br />CITIES; AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The Hays County Commissioners Court has adopted a resolution supporting state <br />legislation to remove the extraterritorial jurisdiction ofthe City of Austin from Hays County, and <br />similar resolutions have been adopted by the governing bodies of the cities of Buda, Kyle and <br />Dripping Springs and the Hays Consolidated Independent School District. <br /> <br />2. Hays County Judge Jim Powers has asked the City Council to adopt a similar resolution. <br /> <br />3. The City Council agrees with the concept oflocal control embodied in these resolutions, <br />and the City Council also recognizes the necessity for the exercise of extraterritorial jurisdiction by <br />cities into areas of adjacent counties, since Texas counties lack significant land use control authority, <br />and many growing cities, including San Marcos, are physically situated in more than one county. <br /> <br />4. The City Council wishes to express its support of the voluntary transfer of extraterritorial <br />jurisdiction by the City of Austin to Hays County cities. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The City Council supports the voluntary transfer of extraterritorial jurisdiction by <br />the City of Austin to the Hays County cities of Dripping Springs, Buda and Hays, in all areas within <br />Hays County where the City of Austin's extraterritorial jurisdiction has displaced the extraterritorial <br />jurisdiction of these Hays County cities. <br /> <br />PART 2. As Hays County cities annex new areas and their extraterritorial jurisdictions <br />would normally expand, the City Council supports the ongoing voluntary transfer of extraterritorial <br />jurisdiction by the City of Austin to the Hays County cities for areas in Hays County where the <br />expansion of the cities' extraterritorial jurisdiction overlaps the City of Austin's extraterritorial <br />jurisdiction. <br /> <br />PART 3.
