IIIHJ -. r.-! ~Oi 0 ~~ 147 ORDINANCE 1999---.rr AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 2.25 ACRE TRACT OF PROPERTY LOCATED IN THE 1600 BLOCK OF RIVER ROAD FROM "C" COMMERCIAL DISTRICT TO "MF-3" MULTI-FAMILY DISTRICT (HIGH DENSITY); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENAL TIES. RECITALS: 1. On October 27,1998, the Planning and Zoning Commission of the City of San Marcos held a public hearing regarding a request to change the zoning from "C" Commercial District to "MF-3" Multi-Family District (High Density) for a 2.25 acre tract of property located in the 1600 Block of River Road. 2. Subsequent to the public hearing on that date, the Planning and Zoning Commission did, on October 27, 1998 consider and vote to approve the request, and has recommended that the request be approved by the City Council of the City. 3. The City Council held a public hearing on the 26th day of April , 1998, regarding the request. 4. All requirements of Chapter 114, Zoning, ofthe San Marcos City Code pertaining to zoning map amendments have been met. 5. The City Council hereby finds and determines that the adoption of the following ordinance is in the interest of the public health, morals, welfare and safety. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 of the San Marcos City Code, is amended to rezone the following real property which is presently zoned "C" Commercial District to "MF-3" Multi-Family District (High Density): Street address: 1600 Block of River Road. Size: 2.25 acres. Legal description: See the metes and bounds description attached as Exhibit A, Deed or olat reference: Volume 361, page 166, Hays County Deed Records. SECTION 2. Any person violating any provision of this ordinance commits a misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. SECTION 3. All ordinances or parts of ordinances in conflict with this ordinance are repealed. The publication of notice on April 4, 1999 of the public hearing by the City Council is validated, and for this purpose, this ordinance supersedes Section 114.023 of the City Code. SECTION 4. After its original passage, this ordinance will be subject to reconsideration at the next regular City Council meeting. If this ordinance is not reconsidered, or if it is reconsidered and approved, notice of its adoption will be published in a newspaper of general circulation in the City. This ordinance will take effect upon publication of this notice.
