<br />154 <br /> <br />RESOLUTION 1999 - 90 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS APPROVING A REVISED LEASE OF PROPERTY AT THE SAN <br />MARCOS MUNICIPAL AIRPORT TO BERRY AVIATION, INC.; <br />AUTHORIZING THE CITY MANAGER TO SIGN THE LEASE; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. Berry Aviation, Inc. ("Berry") proposes to lease airport property for the purpose of <br />constructing an aircraft hangar. Berry expects to sub-lease space in the new hangar to <br />private individuals. <br /> <br />2. The Airport Commission reviewed this request on January 12,1999, and they <br />unanimously recommended approval of a lease. <br /> <br />3. The City Council approved an earlier version of this lease on March 22, 1999; Berry <br />subsequently requested revisions to the lease, and the attached revised lease has been <br />negotiated by the parties to substitute for the earlier version of the lease . <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The attached Revised Lease of Unimproved Airport Property for <br />Construction and Operation of Business Facilities between the City and Berry Aviation, Inc. <br />is approved. <br /> <br />PART 2. The City Manager, Larry D. Gilley, is authorized to execute this revised <br />lease on behalf of the City. <br /> <br />PART 3. This Resolution annuls and replaces the resolution adopted on March 22, <br />1999 approving the earlier version of the lease. <br /> <br />PART 4. This resolution shall be in full force and effect from and after its passage. <br /> <br />ADOPTED this 26th day of April 1999. <br /> <br />~~~~~ <br /> <br />Billy G.
