<br />~ <br /> <br />o~ ~ <br />We;) 0 <br />.,J ~o rt'\ <br />_~ 0:: <br />LL1-' ~ <br />a! <br /> <br /> <br />168 <br /> <br />ORDINANCE 1999- <br /> <br />31 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, CANVASSING RETURNS AND <br />DECLARI NG RESULTS OF THE GENERAL ELECTION HELD <br />ON MAY 1, 1999 FOR THE PURPOSE OF ELECTI NG A CITY <br />COUNCIL MEMBER, PLACE 3, AND A CITY COUNCIL <br />MEMBER, PLACE 4; AND DECLARING AN EMERGENCY. <br /> <br />RECITALS: <br /> <br />1. The City Council ordered that a General Election be held on May 1, 1999 for the <br />purpose of electing a City Council Member, Place 3, and a City Council Member Place 4. <br /> <br />2. Notice of this election was duly published in the San Marcos Daily Record on April <br />18, 1999. <br /> <br />3. Copies of this notice were duly posted at each city election precinct polling place <br />prior to the election, and a copy of the notice was posted on the bulletin board at City Hall <br />on February 18, 1999. <br /> <br />4. This election was duly and legally held on the 1st of May, 1999, in conformity with <br />the election laws of the State of Texas, and the results of the election have been certified <br />and returned by the proper judges and clerks. <br /> <br />5. The City Council of the City of San Marcos, Texas with the following members <br />present: Billy G. Moore, Ed Mihalkanin, Jane Hughson, Louis Doiron, Jr., Earl <br />Moseley, Jr, Joe B. Cox, Jrand Rick Hernandez has today considered the returns of <br />the General election held on the 1st of May, 1999. <br /> <br />6. It appears to the Council, and the Council.finds, that the election was in all respects <br />lawfully held. <br /> <br />7. It appears to the Council, and Council finds, that the tabulation of the results of the <br />election is correct. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The General election of May 1, 1999 was duly called, notice of the <br />election was given in accordance with law, and the election was held in accordance with <br />law. <br /> <br />SECTION 2. The tabulation of votes cast in the General election held on May <br />1,1999 for the purposes stated in recital 1 above, a copy of which is attached to and made <br />a part of this ordinance, is adopted as the official tabulation of the votes cast at the <br />election, and the tabulation will be filed and recorded in the official records of the City of <br />San Marcos as the official canvass of the election. <br /> <br />SECTION 3. The official canvass of the returns ofthe election reflects the following: <br /> <br />A. That the following person was duly elected City Council Member, Place 3 of <br />the City of San Marcos: Jane Hughson <br /> <br />B. That the following person was duly elected City Council Member, Place 4 of <br />the City of San Marcos: Joe B. Cox, Jr. <br /> <br />SECTION 4. The importance of this Ordinance creates an emergency and an <br />imperative public necessity, and the provisions of the Charter requiring that ordinances be <br />presented at three separate meetings, and that ordinances do not take effect until ten (10) <br />
