<br />1 Section 6.02 -Pass-through of Electricity Cost. In addition to the monthly Service Fee <br />2 payments, the City shall pay monthly to GBRA the electricity cost for the Plant in the amount <br />3 billed by the electric service provider. All other utility costs shall be borne by GBRA as part <br />4 ofthe Service Fee. <br />5 <br />6 Section 6.03 - Monthly Payment of Service Fee. The City shall make Service Fee <br />7 payments by the 15th of each month for services performed the previous month. Payment of <br />8 the Service Fee will commence after issuance of the Notice to Proceed. <br />9 <br />lO Section 6.04 - Construction Phase. Payments to GBRA for Construction Phase Services <br />11 shall be made monthly based on monthly reports of the actual work activities of GBRA. <br />12 Construction Phase Services will terminate upon issuance ofthe Notice to Proceed by the <br />13 City to GBRA. <br />14 <br />15 Section 6.05 - Start-up Period. The City shall not be required to begin paying the Service <br />16 Fee until potable water which meets the Performance Standards is delivered from the high <br />17 service pump station to the City distribution system. <br />18 <br />19 Section 6.06 - Uncontrollable Circumstances; Impact on Service Fee. If an <br />20 Uncontrollable Circumstance described in Article 8 causes GBRA's costs of operation and <br />21 maintenance of the Project to increase, the City will pay the actual amount of the cost <br />22 increase to GBRA. Prior to any adjustment in the Service Fee, the City may determine that <br />23 the amount of the cost increase could be reduced by the undertaking of a Project <br />24 Modification. Ifthe City so determines, the City may cause the Project Modification to be <br />25 undertaken in accordance with Article 7 of this Contract. <br />26 <br />27 Section 6.07 - Changes to the Service Fee. <br />28 A. Except as covered by Section 6.10, the Service Fee may be changed only through <br />29 a request by GBRA that is approved by the CIty. Any request for a change in the Service Fee <br />30 shall be based on written notice delivered to the City by GBRA within seven days of the <br />31 occurrence of the event giving rise to the request. GBRA shall deliver a written notice to the <br />32 City of the amount of the request with all supporting data within 30 days ofthe occurrence. <br />33 B. Determination of Changes to Service Fee. The value of any work covered by <br />34 GBRA's request for an increase or decrease in the Service Fee shall be determined in one of <br />35 the following methods: <br />36 1. Where the costs involved are covered by unit prices contained in the Cost <br />37 Proposal Form, by application of unit prices to the quantities of the items involved. <br />38 2. By mutual acceptance of a lump sum. If requested by the City, GBRA shall <br />39 furnish an itemized cost breakdovm together with supporting data including the <br />40 quantities used in computing the lump sum. <br />41 3. If (B)(1) or (B)(2) are not used, then the value will be determined on the basis of <br />42 GBRA's actual costs directly related to the work involved, plus 15%.
