<br />1 and management of the Project and to establish the initial contract term. <br />2 <br />3 Operation and Maintenance }v!anual - The predictive and preventive maintenance <br />4 procedures, practices and schedules to provide for prudent and preventive operation and <br />5 maintenance of the Project in accordance with Applicable Law, Prudent Industry Practices, <br />6 equipment manufacturers' instructions and operation and maintenance manuals, and <br />7 regulatory requirements, so as to obtain, for each piece of equipment and for each <br />8 component, a useful life that corresponds to or exceeds in duration industry standards and <br />9 expectations. This manual is to be provided by GBRA and approved by the City and the <br />10 TNRCC. <br />11 <br />12 Performance Standards - The standards for the treatment of water described in Article 9 of <br />13 the Contract. <br />14 <br />15 Performance Test - The test to be conducted by GBRA to determine GBRA's ability to <br />16 reliably produce potable water that meets the Performance Standards. <br />17 <br />18 Performance Test Plan - The plan developed by GBRA and approved by the City for <br />19 conducting the Performance Test in accordance with the procedures set forth in the Contract. <br />20 <br />21 Plant - The San Marcos Regional Surface Water Treatment Plant. <br />22 <br />23 Plant j\1anager - GBRA's representative at the Project who has the authority to act on behalf <br />24 of GBRA. All communications given to the Plant Manager shall be as binding as if given <br />25 to GBRA. <br />26 <br />27 Potable Water - Water treated by the Plant that meets the Performance Standards and the <br />28 requirements of Applicable Law for domestic uses and human consumption. <br />29 <br />30 Project - The operation, maintenance and management of the Plant, including the clear well <br />3l storage and high service pump station. GBRA' s responsibility for plant piping begins at the <br />32 discharge from the raw water meter on the plant property and terminates at the discharge <br />33 from the finished water meter after the high service pump station. <br />34 <br />35 Project Modjfication - Any improvement, alteration, addition or any other modification to <br />36 the Project or any part thereof (other than maintenance, repair and replacements). <br />37 <br />38 Proposal - The entire proposal submitted by GBRA in response to the RFP. <br />39 <br />40 Prudent Industry Practices - Those methods, techniques, standards and practices which, at <br />41 the time they are to be employed and in light of the circumstances known or reasonably <br />42 believed to exist at the time, are generally accepted as prudent in the municipal water supply <br />43 and surface water treatment industries as practiced in the Central Texas region. <br />44 <br />45 Raw Water - All water entering the Plant for treatment. <br />46 <br />47 Residue - Any liquid, semi-solid, solid material or sludge resulting from or a byproduct to <br /> <br />SAN MARCOS REGIONAL <br />SURFACE WATER TREATMENT PLANT <br /> <br />OPERATION CONTRACT <br /> <br />5-6-99 <br />PAGE 2 <br />
