<br />1 Section 4.03 - Project Start-Up Period. Prior to the Commencement Date, GBRA shall <br />2 operate the facilities under a Project Start-Up Period. This period shall begin upon issuance <br />3 to the construction contractor a certificate of substantial completion by the City's engineer <br />4 and shall continue until issuance by the City for GBRA to initiate the Performance Test. <br />5 During this time, GBRA shall be required to be on-site to participate in project start-up <br />6 activities including training, equipment testing oversight, operations and maintenance manual <br />7 preparation, and shall conduct the necessary activities to promote proper stabilization and <br />8 calibration of the Project treatment units and instrumentation. <br />9 <br />10 Section 4.04 - Performance Test. Upon completion of the Project Start-Up Period, GBRA <br />II shall be required to pass the Performance Test described in Article 12. The Performance <br />12 Test shall be designed to demonstrate that GBRA can operate the Project to meet the <br />13 Performance Standards and the Contract Standards. During the Performance Test, GBRA <br />14 shall remain fully responsible for operating and maintaining the Project in accordance with <br />15 the scope of services as set forth in the Contract. The City shall have the right to take all <br />16 necessary actions to ensure that potable water produced by the Project during the <br />17 Performance Test is suitable for distribution to the San Marcos distribution system. <br />18 <br />19 Section 4.05 - Cost of Operations During Testing. All costs and expenses incurred by <br />20 GBRA related to the Project Start-up Period operations and the Performance Test, and any <br />21 costs of the City in connection with any retesting due to GBRA failure of the initial <br />22 Performance Test, shall be borne by GBRA. GBRA shall not be entitled to any payment <br />23 prior to passing the Performance Test, with the exception of construction related services. <br />24 Amounts accrued during the Project Start-up Period and the Performance Test period shall <br />25 be paid to GBRA upon successfully completing the Performance Test. GBRA shall have 30 <br />26 days to pass the Performance Test, a period which includes a time allowance for an initial <br />27 test and one re-test. IfGBRA fails to pass the Performance Test within that period, the City <br />28 may terminate the Contract, the costs and expenses for testing shall not be payable, and the <br />29 City may pursue all remedies for GBRA default. <br />30 <br />31 Section 4.06 - Training. GBRA shall be responsible for training the management, <br />32 supervisory, technical, laboratory, operations, and maintenance personnel. <br />33 <br />34 Section 4.07 - Maintenance. GBRA shall maintain the Project in accordance with the <br />35 Contract Standards, shall comply with the Operations and Maintenance Manual, shall <br />36 maintain the SCADA system, and shall keep complete daily and monthly maintenance logs. <br />37 GBRA shall also maintain a full spare parts inventory. GBRA must provide (monthly and <br />38 annually) detailed accounting and service records to verify maintenance tasks undertaken and <br />39 related costs. <br />40 <br />41 Section 4.08 - Maintenance and Repair Responsibility. <br />42 A.
