<br />17. <br /> <br />RESOLUTION 1999-108 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS GRANTING A SPECIFIC USE PERMIT TO JAMES <br />LAMBERT FOR A MOBILE HOME AT 431 RIVERSIDE DRIVE; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. James Lambert owns property and a business at 431 Riverside Drive, and he has <br />maintained a mobile home there under specific use permits granted by the Planning and Zoning <br />Commission. Mr. Lambert recently requested renewal of the SUP for the mobile home. <br /> <br />2. The Planning and Zoning Commission considered the request at its March 220d meeting, <br />and voted 9-0 to deny the request. <br /> <br />3. Mr. Lambert, through his attorney Mr. Joseph Lobley, filed an appeal of the SUP denial <br />with the City Secretary's office under City Code Section 114.027. <br /> <br />4. The City Council finds that the appeal has merit, and that 1) the proposed use meets all <br />the minimum standards established in City Code Chapter 114 and other applicable ordinances, and <br />is consistent with the policies of the city master plan, and 2) the proposed use will not be detrimental <br />to the health, welfare and safety of the surrounding neighborhood or its occupants, or be substantially <br />or permanently injurious to neighboring property. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The City Council sustains the appeal of James Lambert and approves the granting <br />of a specific use permit to Mr. Lambert for the use of a mobile home at 431 Riverside Drive for a <br />period of 18 months, subject to the conditions for mobile homes stated in City Code Section <br />114.578(b). <br /> <br />PART 2. This resolution is effective immediately upon its passage and adoption. <br /> <br />ADOPTED this 24th day of <br /> <br />May <br /> <br />, 1999. <br /> <br />~~~~ <br /> <br />Billy G.
