I J-� <br />RESOLUTION N0.2012- 28R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, REQUESTING A PRIVATE SALE OF PROPERTY <br />DESCRIBED AS PART OF LOT 8, BLOCK 12, D.S.COMBS ADDITION <br />(TAX ACCOUNT NO. R24712) ACQUIRED BY THE CITY OF SAN <br />MARCOS, TEXAS IN TRUST FOR ITSELF, AN MARCOS <br />CONSOLIDTATED INDEPENDENT SCHOOL DIS CT, AND HAYS <br />COUNTY, TEXAS AT A DELINQUENT TAX SA ; AND DECLARING <br />AN EFFECTIVE DATE. <br />RECITALS: <br />1. The following de/ibed as offered for sale by the Constable of Hays <br />County, Texas at public auction ent of foreclosure for delinquent taxes by the <br />District Courts of Hays County. <br />2. The following ded not receive sufficient bids as set by law and <br />was struck off to The City of S Trustee, for the use and benefit of itself, San <br />Marcos Consolidated Indepe ent School District and Hays County, Texas, pursuant to Section <br />34.010) Texas Tax Code. <br />3. Texa ax Code § 34.05 (i) provides that a taxing unit that purchased the property <br />pursuant to secti 34.01 of the Texas Tax Code may sell the property at a private sale for an <br />amount less t n the minimum bid set by law with the consent of each taxing unit entitled to <br />receive proc eds of the sale under the judgment. <br />E IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />PART 1. That the City of San Marcos, Texas, does hereby request, that upon <br />receiving this consent and the consent of Hays County, Texas and the San Marcos Consolidated <br />Independent School District, that the Mayor or City Manager of the City of San Marcos conduct <br />a private sale in the manner prescribed by the section 34.05 (i) of the Texas Tax Code and sell <br />the following described property to Billingsley Co., Inc., a Texas Corporation for $1,000.00 cash: <br />Property to be sold: Tax Account 824712, Part of Lot 8, Block 12, D.S. Combs <br />Addition to the City of San Marcos, Hays County, Texas being that same property <br />conveyed to Della Jackson on June 12, 1948, by that certain deed of record in Volume <br />141, Page 467, Deed Records of Hays County, Texas. <br />PART 2. That the Mayor or City Manager of the City of San Marcos, Texas, is <br />authorized to execute any deed necessary to convey the property sold pursuant to this Resolution. <br />PART 3.
