<br />structure or storm drain in or upon the San Marcos River. <br /> <br />~ Employees of the department, peace officers, park rangers, and emergency personnel <br />are exempt from these rules to the extent these rules conflict with the discharge of their official <br />duties. <br /> <br />SECTION 2. This ordinance will continue in effect from and after the date of it's <br />adoption for a period of90 days, after which time the amendments made to City Code Chapter 58, <br />Article 3, Section 58.070 as contained in Section 1 of this ordinance will expire and Section 58.070 <br />will revert to its form immediately prior to the adoption of this ordinance. <br /> <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is <br />held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br />this ordinance will continue in force if they can be given effect without the invalid portion. <br /> <br />SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br /> <br />SECTION 5. Any person violating any provIsIon of this ordinance commits a <br />misdemeanor and is subject to the penalties provided in Section 1.015 of the San Marcos City Code <br />upon conviction. <br /> <br />SECTION 6. Pursuantto Y.T.C.A. Parks and Wildlife Code ~ 31.092(d), a copy of this <br />Ordinance will be filed with the Texas Parks and Wildlife Department. <br /> <br />SECTION 7.
