<br />2.9 During the time any information that identifies an individual covered by this Plan is in the <br />Claims Administrator's custody or control, the Claims Administrator shall take all <br />reasonable precautions to prevent disclosure or use of the information for a purpose <br />unrelated to administration of the Plan. <br /> <br />The Claims Administrator shall disclose this information only: <br /> <br />( a) in response to a court order; <br /> <br />(b) for an examination conducted by the State Board of Insurance; <br /> <br />(c) for an audit or investigation conducted under the Employee Retiree Income <br />Security Act of 1974 (29 U.S.C. 1001, et seq.); <br /> <br />(d) to or at the request of the insurer or the Company; <br /> <br />(e) with the written consent of the identified individual or his or her legal <br />representative; or <br /> <br />(t) to individuals who need to know the information in order to implement the <br />terms of the Plan. <br /> <br />2.10 The Claims Administrator shall maintain at its principal administrative office adequate <br />books and records of all transactions in which the Plan Administrator engages with <br />insurers, Plans, and Plan participants. <br /> <br />The books and records will be maintained by the Claims Administrator for the term of the <br />written agreement to which they relate and for the six-year period following the end of <br />such written agreement's term unless the Plan Administrator requests and takes <br />possession of the physical files. <br /> <br />The Claims Administrator shall maintain the books and records in accordance with <br />prudent and generally accepted standards of insurance record keeping. <br /> <br />An insurer and the Plan Administrator and an auditor designated by the Plan <br />Administrator are is entitled to continuing access to these books and records sufficient to <br />permit the insurer and the Plan Administrator to fulfill contractual obligations to insurers <br />and Plan participants and legal obligations as a governmental entity. The right provided <br />by this subsection is subject to any restrictions included in the written agreement between <br />the Claim Administrator and the insurer, Plan, or the Company relating to proprietary <br />rights of the parties of the books and records. <br /> <br />2.11 The Claims Administrator shall provide timely written reports to the Plan Administrator <br />as follows; <br />(a) Daily or Weekly: <br /> <br />4 <br />
