<br />~ <br />~ <br />~ <br />1"\...... <br />N <br /> <br />::E <br /> <br />~l <br />~~ <br />\ '. <br /> <br /> <br />114 <br /> <br />ORDINANCE 1999-----.J2.. <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING THE OFFICIALZONING <br />MAP OF THE CITY BY REZONING A 0.81 ACRE TRACT OF <br />PROPERTY LOCATED AT 1418 AND 1422 RIVER ROAD <br />FROM "PD" PRE-DEVELOPMENT DISTRICT TO "MF-2" <br />MULTI-FAMILY DISTRICT (MEDIUM DENSITY); INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENAL TIES. <br /> <br />RECITALS: <br /> <br />1. On May 11, 1999, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning from "PD" Pre- <br />Development District to "MF-2" Multi-Family District (Medium Density) for a 0.81 acre tract <br />of property located at 1418 and 1422 River Road. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on May 11, 1999 consider and vote to approve the request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 12th <br />July , 1999, regarding the request. <br /> <br />day of <br /> <br />4. All requirements of Chapter 114, Zoning, ofthe San Marcos City Code pertaining <br />to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map of the City, as described in Section 114.029 <br />of the San Marcos City Code, is amended to rezone the following real property which is <br />presently zoned "PD" Pre-Development District to "MF-2" Multi-Family District (Medium <br />Density): <br /> <br />Street address: <br /> <br />1418 and 1422 River Road. <br /> <br />Size: 0.81 acres. <br /> <br />Legal description: See the metes and bounds description attached as Exhibit A. <br />Note: 0.19 acres of the tract described is within the right-of-way of River Road. <br /> <br />Deed or plat reference: Volume 279, pages 624-628, Hays County Deed Records. <br /> <br />SECTION 2. The Future Land Use Plan of the San Marcos Horizons City Master <br />Plan is revised to conform to this zoning map amendment. <br /> <br />SECTION 3. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 4. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br />in a newspaper of general circulation in the City. This ordinance will take effect upon <br />publication of this notice. <br />
