The determination of the drainage charges is deemed nondiscriminatory, <br />reasonable and equitable to provide for the creation, operation, planning, engineering, inspection, <br />construction, repair, maintenance, improvement, reconstruction and administration of the drainage <br />utility . <br /> <br />(b) The drainage charges will be set by separate ordinance based on the following factors: <br /> <br />(1) The developed use of the benefitted property; <br /> <br />(2) The number of dwelling units on the benefitted property; and <br /> <br />(3) The amount of impervious cover on the benefitted property. <br /> <br />(c) The director will determine the category that applies to each benefitted property within <br />the guidelines set forth herein and will recommend the charge in accordance with the category of use <br />and the following factors: <br /> <br />(1) Categories of land use. Each benefitted property will be placed by the director in a <br />specific category of land use based upon the actual use of the property. These <br />categories will include but not be limited to residential and commercial. <br /> <br />(2) Impervious cover. The amount of impervious cover existing on each benefitted <br />property designated by the director as being in a category of land use other than <br />residential. <br /> <br />(3) Residential units. The number of residential units existing on a particular benefitted <br />property. <br /> <br />(d) The monthly charge for each lot or parcel will be calculated using an ERU billing system. <br />Each residential unit, whether single family or multi -family, will be billed for one ERU. The number <br />of ERUs billed to a commercial property will be based on the property's size and the ratio of <br />impervious cover on the property to the average impervious cover associated with the average <br />residential unit. Calculations will be subj ect to credits under subsection (e). <br /> <br />(e) A user may apply for a credit towards the drainage charge for property upon which, or <br />in connection with which, drainage improvements have been constructed. The credit will be up to <br />50% of the drainage charge. The credit will be based upon the extent to which drainage t10ws from <br />impervious cover on the property are mitigated by the drainage improvements, according to <br />standards developed by the drainage advisory board and approved by the city council. The amount <br />of credit will be determined by the drainage advisory board after consultation with the director. The <br />user has the burden of proof when applying for a credit and must provide the director information <br />reasonably required by the director to make a determination. Failure to timely provide information <br />requested by the director is a sufficient reason to deny a requested credit. <br /> <br />(f) The monthly charge per ERU is established in a separate ordinance and is based on <br />the revenue required to support the drainage utility divided by the total number ofERU s to be billed. <br /> <br />(g) The city council reserves the right to adjust the drainage charges by separate ordinance <br />from time to time. <br /> <br />(h) Billing of the drainage charge against each benefitted property within the service area will <br />be accomplished by a separate listing in the monthly city utility bill. These bills will become due <br />and payable in accordance with the rules and regulations of the city pertaining to the collection of <br />water and wastewater fees and charges. <br /> <br />(i) No utility deposit will be required as a precondition to accepting surface t10w from a <br />benefitted property in the drainage utility. <br /> <br />DU07-12-99.wpd <br /> <br />Page 4 <br />
