RESOLUTION 2012 - 35 R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AUTHORIZING THE FILING OF THREE GRANT <br />APPLICATIONS WITH THE CAPITAL AREA COUNCIL OF <br />GOVERNMENTS FOR FY 2012 /2013 REGIONAL SOLID WASTE <br />PROGRAM GRANTS IN THE AMONT OF $12,000.00 FOR DISPOSAL <br />SERVICES $2,500.00 FOR A SOLAR OPERATED OUTDOOR SCALE <br />AND $4,400.00 FOR COMPOSTING EQUIPMENT; PLEDGING THAT IF <br />THE CITY RECEIVES GRANT AWARDS IT WILL COMPLY WITH <br />THE GRANT REQUIREMENTS OF CAPCOG, THE TEXAS <br />COMMISSION ON ENVIRONMENTAL QUALITY AND THE STATE OF <br />TEXAS; AUTHORIZING THE CITY MANAGER TO ACT ON BEHALF <br />OF THE CITY IN ALL MATTERS RELATED TO THE GRANT <br />APPLICATIONS AND ANY SUBSEQUENT GRANT AGREEMENTS AND <br />DECLARING AN EFFECTIVE DATE. <br />RECITALS: <br />1. The Capital Area Council of Governments ( "CAPCOG ") is directed by the Texas <br />Commission on Environmental Quality ( "TCEQ ") to administer solid waste grant funds for the <br />implementation of CAPCOG's adopted regional solid waste management plan. <br />2. The City is qualified to apply for grand funds under the Request for Applications <br />process. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The filing of three grant applications with CAPCOG through the FY <br />2012/2013 Regional Solid Waste Grants Program in the amount of $12,000.00 for disposal <br />services, $2,500.00 for a solar operated outdoor scale and $4,400.00 for composting equipment is <br />approved. <br />PART 2. The City Manager is authorized to request grant funding under the <br />CAPCOG Request for Applications of the Regional Solid Waste Grants Program for the <br />household hazardous waste program and act on behalf of the City in all matters related to the <br />grant applications and any subsequent grant contracts and grant projects that may result. <br />PART 3. If the projects are funded, the City will comply with the grant requirements <br />of CAPCOG, TCEQ, and the State of Texas. <br />PART 4. The grant funds and any grant- funded equipment will be used only for the <br />purposes for which they are intended under the grant. <br />1 <br />
