The City Council wishes to revise the City Code provision regarding appointments to the <br />Planning and Zoning Commission in order to specify when routine appointments are made and when <br />they take effect, and to prescribe educational qualifications for service on the commission. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. Section 2.091 of the City Code is amended as follows (underlining indicates added <br />language and overstrike indicates deleted language): <br /> <br />Sec. 2.091. Membership; eligibility for appointment; term of office. <br /> <br />(a) The planning and zoning commission consists of nine members. <br /> <br />(b) All of the commission members except two will reside and own real property in the <br />city. One of the remaining members will reside and own real property in the city's extraterritorial <br />jurisdiction, and the other remaining member will reside in the city or the city's extraterritorial <br />jurisdiction, and own real property in the city or the city's extraterritorial jurisdiction. <br /> <br />(c) The council will seek to ensure broad representation and expertise in making <br />appointments to the planning and zoning commission. <br /> <br />(d) Three Mmembers of the planning and zoning commission are appointed in August <br />of each year for staggered three-year terms beginning in November ofthat year, with one-third <br />to be appointed each year on a continuing basis. <br /> <br />(e) Before taking office. a newly appointed member. including a member appointed to <br />fill a vacancy. must attend an orientation meeting with the director of planning and development <br />services, and must attend a seminar on land use. environmental and planning issues approved by <br />the director. The director will advise newly appointed members. of the date and location of <br />approved seminars. and members are entitled to reimbursement for reasonable costs of <br />attendance. If a newly appointed member fails to fulfill these attendance requirements within <br />three months of being appointed, the appointment is automatically rescinded and the city council <br />will make a new appointment. <br /> <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be <br />unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance <br />will continue in force if they can be given effect without the invalid portion. <br /> <br />SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in conflict with <br />this ordinance are repealed. Members of the Planning and Zoning Commission as of the effective <br />date of this ordinance will continue to hold office until their successors are appointed and duly <br />qualified under the terms of this ordinance. <br /> <br />SECTION 4. Any person violating any provision of this ordinance commits a misdemeanor and <br />is subject to the penalty provided in Section 1.015 ofthe San Marcos City Code upon conviction. <br /> <br />SECTION 5. This Ordinance will take effect 10 days after the date of its final passage, and the City <br />
