<br />144 <br /> <br />RESOLUTION 1999- 140 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS APPROVING AN EXTENSION OF <br />THE CITY'S WATER SYSTEM TO SERVE THE SAN <br />MARCOS BAPTIST ACADEMY PROPERTY AND THE FIRST <br />CHRISTIAN CHURCH PROPERTY ON RANCH ROAD 12; <br />APPROVING A REIMBURSEMENT AGREEMENT FOR THE <br />EXTENSION; AND DECLARING AN EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. City Code Section 86.003(c) requires City Council approval for the extension <br />of City water mains to serve uses outside the City limits. <br /> <br />2. The San Marcos Baptist Academy and the First Christian Church (the <br />"Applicants") have requested permission to extend a City water main to serve their <br />respective properties at 2801 Ranch Road 12 and 3105 Ranch Road 12, which are outside <br />the city limits. <br /> <br />3. This water main extension appears to be feasible and is to be constructed <br />as a part of the City's Northwest Water System Improvements Project, at the sole expense <br />of the Applicants under the attached reimbursement agreement with the City. <br /> <br />4. The City Council is willing to approve this request on the express condition <br />that the Applicants, on behalf of themselves, their successors and assigns, consent to the <br />annexation of the Applicants' respective properties at such time as they are adjacent to the <br />City limits. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. An extension of the City's water system to serve the Applicants' respective <br />properties is approved, subject to the express condition that the Applicants, on behalf of <br />themselves, their successors and assigns, consent to the annexation of the Applicants' <br />respective properties at such time as they are adjacent to the City limits. <br /> <br />PART 2. The Reimbursement Agreement attached to this resolution between the <br />City and the Applicants for reimbursement by the Applicants of the cost of extending a City <br />water main to the Applicants' respective properties is approved, and the City Manager, <br />Larry D. Gilley, is authorized to execute the agreement on behalf of the City. <br /> <br />PART 3. A change order for the Northwest Water System Improvements Project <br />for the extension of the water main in the amount of $24,480 is approved. <br /> <br />PART 4.
