<br />146 <br /> <br />RESOLUTION 1999- 141 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, APPROVING AND ADOPTING A <br />FLEXIBLE BENEFITS PLAN FOR CITY EMPLOYEES; <br />APPROVING EXECUTION OF THE PLAN BY THE CITY <br />MANAGER; AN DECLARING AND EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. Flexible benefit plans are authorized under Section 125 of the Internal <br />Revenue Code. The advantage of participating in a flexible benefit plan is that <br />contributions to the plan are not taxed to employees for federal income tax or to employees <br />or employers for social security purposes. Participation categories include premium <br />conversion (medical and dental care contributions), unreimbursed medical and dependent <br />care expenses within plan and IRS guidelines. Savings for the City of San Marcos plan are <br />currently estimated to be $13,000 annually. <br /> <br />2. The new Flex Administrator, Plan Data has recommended adoption of a <br />resolution for fullest compliance with IRS guidelines. The attached revised Flexible <br />Benefits Summary Plan Description commences for the benefit plan year starting August <br />1,1999. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />PART 1. The form of Cafeteria Plan (flexible benefits plan) for City employees, <br />including a Dependent Care Assistance Progra'm and Health Care Reimbursement Plan <br />effective August 1, 1999, (the "Plan") is approved and adopted and the City Manager, Larry <br />D. Gilley, is authorized and directed to execute and deliver to the Administrator of the Plan <br />one or more counterparts of the Plan. <br /> <br />PART 2. The City Manager is directed to instruct Group Administrators-San Antonio <br />to take such actions that are deemed necessary and proper in order to implement the Plan, <br />and to set up adequate accounting and administrative procedures to provide benefits under <br />the Plan. <br /> <br />PART 3. The City Human Resources Department staff is directed to act as soon <br />as possible to notify City employees of the adoption of the Cafeteria Plan by delivering to <br />each employee a copy of the summary description of the Plan in the form of the Summary <br />Plan Description attached to this Resolution, which form is approved. <br /> <br />PART 4.
