The Main Street Advisory Board has requested that the City Council reduce the "layoff' period <br />during which City board and commission members who have served two consecutive terms are <br />ineligible for reappointment from one term of office to one year. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. Section 2.068 of the City Code is amended as follows (underlining indicates added <br />text; Ovc15ttike indicates deleted text): <br /> <br />Sec. 2.068. Limitation on successive terms of office. <br /> <br />(a) A person may not be appointed to a term of office on a city board or commission if <br />the person has served two consecutive terms of office on the board or commission immediately <br />prior to the term for which the appointment is being considered. <br /> <br />(b) For purposes of this section, a person is deemed to have served a term of office on a <br />board or commission if the person serves more than one-half of a regular term of office on the <br />board or commission. <br /> <br />(c) This section does not apply to appointinents to boards and commissions to which the <br />city exercises appointment authority over only one position or to appointments to boards and <br />commissions where limitations on successive terms of office differ from those prescribed in this <br />section which are specifically established by ordinance, by the Charter or by state law. <br /> <br />(d) This section does not apply where good cause exists to appoint a person for a third <br />consecutive term. For this purpose, good cause includes but is not limited to circumstances in <br />which more than one-half of the members of a board or commission are inexperienced with the <br />work of the board or commission, in which case members may be reappointed for only one <br />additional term. <br /> <br />(e) A person who is not eligible for reappointment to a board or commission under this <br />section remains ineligible for a period of one vear from the date the person's term expires. time <br />equal to one Icgmm teUll of offic.e of the bOMd 01 commission. <br /> <br />(f) A person who is not eligible for reappointment to a board or commission under this <br />section is eligible for appointment to any other board or commission. <br /> <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br /> <br />SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br /> <br />SECTION 4. This Ordinance will take effect 10 days after the date of its final passage, and <br />the City Secretary will publish notice of its adoption in a newspaper of general circulation in the <br />City. <br /> <br />PASSED AND APPROVED on first reading <br /> <br />July 12, 1999. <br /> <br />1 <br />
