D-~ o 'U .-l ii:;\ ~ ..~. ~ ~ i'-' ~I ~:o 1.U:aE O::c; ~~ ~ o 175 ORDINANCE 1999- 67 (3- ~ - .... ~ <5 W 5ii:i: WJ~ CI) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 1.47 ACRES, MORE OR LESS, LOCATED OFF OF THE 1600 BLOCK OF POST ROAD; APPROVING A SERVICE PLAN FOR THIS TRACT; PROVIDING FOR PUBLICATION AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. The City Council of the City of San Marcos, Texas, provided an opportunity for all interested persons to be heard at two (2) public hearings, held on June 14, 1999 and on .Tune 28. 1 qqq , to consider the proposed annexation by the City of 1.47 acres, more or less, located off of the 1600 block of Post Road, Hays County, Texas, described by metes and bounds in the attached Exhibit A (the "Annexation Area"). 2. An on-site public hearing has not been requested in writing by more than 20 adults residing in the Annexation Area. 3. Notices of these public hearings were published in the San Marcos Daily Record, a newspaper having general circulation in the City and in the Annexation Area, on June 4, 1999 and June 17. 1999 , these dates being not more than 20 days nor less than 10 days prior to the respective hearings. 4. Prior to the publication of notices of these hearings, the City Council directed preparation of a service plan that provides for the extension of municipal services to the Annexation Area. 5. The proposed service plan was made available for inspection and explained to residents, if any, of the Annexation Area at the public hearings. 6. The Annexation Area is contiguous and adjacent to the current boundaries of the City. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. The Annexation Area is annexed to the City of San Marcos, Texas. SECTION 2. The Service Plan for the Annexation Area, a copy of which is attached hereto as Exhibit B and incorporated herein for all purposes, is approved. SECTION 3. The corporate limits of the City are extended to include the Annexation Area. SECTION 4. The Annexation Area is a part of the City of San Marcos, Texas, and residents in it are entitled to all the rights and privileges of all citizens of the City, and are bound by the acts, ordinances, resolutions and regulations of the City. SECTION 5 . If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 6. All ordinances and resolution or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 7. Any person violating any provision of this ordinance commits a misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction.
