The City Council of the City of San Marcos, Texas, provided an opportunity for all <br />interested persons to be heard at two (2) public hearings, held on June 14, 1999 <br />and on .Tune 28. 1 qqq , to consider the proposed annexation by the City of 1.47 acres, more <br />or less, located off of the 1600 block of Post Road, Hays County, Texas, described by metes and <br />bounds in the attached Exhibit A (the "Annexation Area"). <br /> <br />2. An on-site public hearing has not been requested in writing by more than 20 adults <br />residing in the Annexation Area. <br /> <br />3. Notices of these public hearings were published in the San Marcos Daily Record, a <br />newspaper having general circulation in the City and in the Annexation Area, on June 4, 1999 <br />and June 17. 1999 , these dates being not more than 20 days nor less than 10 <br />days prior to the respective hearings. <br /> <br />4. Prior to the publication of notices of these hearings, the City Council directed preparation <br />of a service plan that provides for the extension of municipal services to the Annexation Area. <br /> <br />5. The proposed service plan was made available for inspection and explained to residents, <br />if any, of the Annexation Area at the public hearings. <br /> <br />6. The Annexation Area is contiguous and adjacent to the current boundaries of the City. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Annexation Area is annexed to the City of San Marcos, Texas. <br /> <br />SECTION 2. The Service Plan for the Annexation Area, a copy of which is attached hereto <br />as Exhibit B and incorporated herein for all purposes, is approved. <br /> <br />SECTION 3. The corporate limits of the City are extended to include the Annexation Area. <br /> <br />SECTION 4. The Annexation Area is a part of the City of San Marcos, Texas, and residents <br />in it are entitled to all the rights and privileges of all citizens of the City, and are bound by the acts, <br />ordinances, resolutions and regulations of the City. <br /> <br />SECTION 5 . If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br /> <br />SECTION 6. All ordinances and resolution or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br /> <br />SECTION 7. Any person violating any provision of this ordinance commits a misdemeanor <br />and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon <br />conviction. <br />
