Section 98.031 ofthe City Code designates areas offlood hazard within the City <br />as identified by the Federal Emergency Management Agency (FEMA) in a report entitled <br />"The Flood Insurance Study for San Marcos, Texas" dated December 1995. <br /> <br />2. FEMA has issued a Letter of Map Revision (LOMR) in Case No. 98-06-1489P, <br />authorizing a revision to the areas of special flood hazard designated in Section 98.031. <br /> <br />3. An amendment to Section 98.031 is necessary in order to adopt and enforce the <br />authorized revision to the designated areas of special flood hazard. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. Section 98.031 of the San Marcos Code of Ordinances is amended <br />as follows (underlining indicates added text): <br /> <br />Sec. 98.031. Basis for establishinq areas of special flood hazard. <br /> <br />(a) The areas of special flood hazard identified by the Federal Emergency <br />Management Agency in a scientific and engineering report entitled, ''The Flood <br />Insurance Study for San Marcos, Texas," dated December 1995, with <br />accompanying flood insurance rate maps and flood boundary-floodway maps <br />(FIRM and FBFM) and any revisions thereto are hereby adopted by reference <br />and declared to be a part of this article, effective April 4, 1996. <br /> <br />(b) FIRM panels 48209C0227 and 48209C0231 are revised in accordance <br />with the Letter of Map Revision (LOMR) issued to the City by the Federal <br />Emerqencv Management Aqency in Case No. 98-06-1489P effective June 15. <br />1999. <br /> <br />SECTION 2. Ifanyword, phrase, clause, sentence, or paragraph of this ordinance <br />is held to be unconstitutional or invalid by a court of competent jurisdiction, the other <br />provisions of this ordinance will continue in force if they can be given effect without the <br />invalid portion. <br /> <br />SECTION 3. All ordinances and resolution or parts of ordinances or resolutions <br />in conflict with this ordinance are repealed. <br /> <br />SECTION 4. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 5. This Ordinance will take effect 10 days after the date of its final <br />passage, and the City Secretary will publish notice of its adoption in a newspaper of <br />general circulation in the City. <br /> <br />PASSED AND APPROVED on first reading July 26, 1999 <br /> <br />PASSED AND APPROVED on second reading August 9, 1999. <br />
