ORDINANCE 2012 - 24 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AMENDING THE TRAFFIC REGISTER MAINTAINED UNDER SECTION 82.067 OF THE SAN MARCOS CITY CODE BY AMENDING THE SPEED LIMIT IN BOTH DIRECTIONS OF THE FOLLOWING STREETS IN THE MOCKINGBIRD HILLS SUBDIVISION FROM 30 MILES PER HOUR TO 25 MILES PER HOUR: SUNFLOWER LANE, BELMONT DRIVE,WEST DE ZAVALA DRIVE, CLOVERLEAF STREET, EAST DEL SOL DRIVE, PARKVIEW DRIVE, LACEY LANE, SUNCREST LANE AND MOCKINGBIRD DRIVE; AND INCLUDING PROCEDURAL PROVISIONS. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: SECTION 1. Pursuant to Sections 82.003 and 82.066 of the San Marcos Code, on the basis of finding that the prima facie speed limit is unreasonable and unsafe, the traffic register maintained under Section 82.067 of the City Code is amended by adding the following speed limit: Sunflower Lane, both directions, 25 miles per hour; Belmont Drive, both directions, 25 miles per hour; West De Zavala Drive, both directions, 25 miles per hour; Cloverleaf Street, both directions, 25 miles per hour; East Del Sol Drive, both directions, 25 miles per hour; Parkview Drive, both directions, 25 miles per hour; Lacey Lane, both directions, 25 miles per hour; Suncrest Lane, both directions, 25 miles per hour; and Mockingbird Drive, both directions, 25 miles per hour. SECTION 2. The installation of speed limit signs reflecting the speed limits under Section 1 is hereby authorized. SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion.
