The City Council of the City of San Marcos, Texas, provided an opportunity for all <br />interested persons to be heard at two (2) public hearings, held on August 6, 1999 , <br />and on August 9, 1999 , to consider the proposed annexation by the City of 121.74 acres, <br />more or less, located adj acent to the 5200 block ofInterstate Highway 35 South, extending Southeast <br />to and along Francis Harris Lane to the Hays Energy Limited Partnership power plant site, in Hays <br />County, Texas, consisting of the three tracts ofland described by metes and bounds in the attached <br />Exhibits A, B and C (the "Annexation Area"). <br /> <br />2. The City has received petitions for annexation from the owners of the properties included <br />in the Annexation Area. <br /> <br />3. An on-site public hearing has not been requested in writing by more than 20 adults <br />residing in the Annexation Area. <br /> <br />4. Notices of these public hearings were published in the San Marcos Daily Record, a <br />newspaper having general circulation in the City and in the Annexation Area, on July 25, 1999 <br />and J u 1 y 29. 1999 , these dates being not more than 20 days nor less than 10 <br />days prior to the respective hearings. <br /> <br />5. Prior to the publication of notices of these hearings, the City Council directed preparation <br />of a service plan that provides for the extension of municipal services to the Annexation Area. <br /> <br />6. The proposed service plan was made available for inspection and explained to residents, <br />if any, of the Annexation Area at the public hearings. <br /> <br />7. The Annexation Area is contiguous and adjacent to the current boundaries ofthe City. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Annexation Area is annexed to the City of San Marcos, Texas. <br /> <br />SECTION 2. The Service Plan for the Annexation Area, a copy of which is attached hereto <br />as Exhibit D and incorporated herein for all purposes, is approved. <br /> <br />SECTION 3. The corporate limits of the City are extended to include the Annexation Area. <br /> <br />SECTION 4. The Annexation Area is a part of the City of San Marcos, Texas, and residents <br />in it are entitled to all the rights and privileges of all citizens of the City, and are bound by the acts, <br />ordinances, resolutions and regulations of the City. <br /> <br />SECTION 5. The importance of this ordinance cre.ates an emergency and an imperative <br />public necessity, and the provisions of the Charter requiring that ordinances be presented at three <br />separate meetings, and that ordinances do not take effect until ten days after the date of final passage <br />are suspended, and this ordinance will take effect upon publication of notice of its adoption in a <br />newspaper of general circulation in the City. <br />
