On June 22, 1999, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to change the zoning from "C" <br />Commercial District to "Mf-4" Multi-Family District (High Density) for a 7.5 acre tract of <br />property located in the 1100 block of San Marcos Parkway. <br /> <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on June 22, 1999 consider and vote to approve the request, and has <br />recommended that the request be approved by the City Council of the City. <br /> <br />3. The City Council held a public hearing on the 26th <br />July , 1999, regarding the request. <br /> <br />day of <br /> <br />4. All requirements of Chapter 114, Zoning, of the San Marcos City Code pertaining <br />to zoning map amendments have been met. <br /> <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br /> <br />BE IT ORDAINED BY THE CITY COUNCil OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />SECTION 1. The Official Zoning Map ofthe City, as described in Section 114.029 <br />of the San Marcos City Code, is amended to rezone the following real property which is <br />presently zoned "C" Commercial District to "MF-4" Multi-Family District (High Density): <br /> <br />Street address: <br /> <br />1100 block of San Marcos Parkway. <br /> <br />Size: 7.5 acres. <br /> <br />Legal description: Lot 4 Leah Addition. <br /> <br />Deed or plat reference: Volume 7, pages 111-112, Hays County Plat Records. <br /> <br />SECTION 2. The Future land Use Plan of the San Marcos Horizons City Master <br />Plan is revised to conform to this zoning map amendment. <br /> <br />SECTION 3. Any person violating any provision of this ordinance commits a <br />misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos <br />City Code upon conviction. <br /> <br />SECTION 4. After its original passage, this ordinance will be subject to <br />reconsideration at the next regular City Council meeting. If this ordinance is not <br />reconsidered, or if it is reconsidered and approved, notice of its adoption will be published <br />in a newspaper of general circulation in the City. This ordinance will take effect upon <br />publication of this notice. <br /> <br />PASSED, APPROVED AND ADOPTED this 26 day of July , 1999, <br />subject to reconsideration at the next regular City Council meeting scheduled for <br />August 9, 1999. <br />
