The City Manager, Larry D. Gilley, has recommended the creation of a new administrative <br />unit within the City, to be called the Department of Water and Wastewater. <br /> <br />2. The functions of this new department have been performed in the past by the Department <br />of Public Works, and amendments to City Code references are needed to implement this change. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br /> <br />SECTION 1. The creation of a new administrative unit within the City, to be called the <br />Department of Water and Wastewater, is approved. <br /> <br />SECTION 2. The following sections ofthe City Code are amended as follows (underlining <br />indicates added text; OvCISt1ikc indicates deleted text): <br /> <br />A. Sec. 50.083(1) (wastewater facilities in mobile home parks): <br /> <br />(1) Approval required. All proposed sewage disposal facilities shall be approved by the <br />environmental health department and director of public vvork5 water and wastewater prior <br />to construction. The use of septic tanks for the disposal of sewage shall not be approved <br />except when city sewer facilities are not available. <br /> <br />B. Sec. 86.094(c) and (1) (commercial wastewater haulers): <br /> <br />(c) The director of public. vvolks water and wastewater has discretionary authority to reject <br />any load of waste delivered to the pretreatment facility and to limit the quantities of wastes to <br />conform to pretreatment facility capacity. <br /> <br />(f) The director of public vvolks water and wastewater may suspend or revoke an existing <br />registration based upon good cause, including, without limitation, any of the following: <br /> <br />(1 )Any violation of the rules pertaining to haulers of liquid waste. <br /> <br />(2) Delivery of unsuitable wastes to the pretreatment facility. <br /> <br />(3) The provision of false or misleading information on any manifest. <br /> <br />Co Sec. 86.121. definitions of control authoritv and director (industrial wastewater <br />discharge): <br /> <br />Control authority means the director of public works water and wastewater or other official <br />designated by the city manager. <br /> <br />Director means the director of the public. works water and wastewater department or other <br />official designated by the city manager or the director's authorized representative, including the <br />industrial pretreatment manager, unless otherwise specified. <br /> <br />D.
